On your own OP. I've asked several times for some details and all you can say is that you are confident.
And you say that you have taken advice from a solicitor. But that is not a solicitor that you paid for presumably as there are no cost implications in a small claims issue.
And CAB.... Not great.0 -
Make it short and sweat.. something like the following..
Somebody else will know more, but I believe there is bailiffs and a sheriffs office and the latter preferable as bailiffs can be toothless. (from what i've read that is, somebody else will know more)
Can't go to Sheriffs as less than £600.0 -
Equaliser... I've answered the question about who we've sued a few times now. I'm not being funny, and I'm grateful for the help but I don't see why I need to keep going over this.0

For those following the saga, it appears that the OP did not sue in the correct name at all. OP has PM'ed me (and I won't give details) but it seems that a non-entity has been sued. The Defendant doesn't exist as a legal entity at Companies House and isn't an individual.
Accordingly, as there is no defendant, there is no defence. And no possibility of enforcing a default judgment against a non-existent person.
Thought I was right....
Anyway, putting my thinking cap on as to what OP can do (other than sue the !!!! off the solicitor and CAB who said he/she could sue xyz).0 -
We were just told we had to match all correspondence and receipts as if paperwork didn't match then it wouldn't stand up in court, if it came to that.0

We have today received a letter saying that the defendant has applied for the judgement to be set aside. Wonderful0

The letter doesn't say. We'll have to ring the court to find out.
Although it does say on our claim online that on the same day he applied for the judgement to be set aside he requested to change his address. Maybe he's going to say he never received anything.0
