Small claim against large hotel chain

    And you are satisfied that you have issued the claim against exactly the right name? Presumably you had a receipt or contract of some sort from when you paid the deposit? Have you sued the entity that is named on that document?

    Have you actually contacted them yet asking how they plan on satisfying the court judgement?

    This should be your first task before spending any more money on trying to enforce the judgement via the legal channels.

    As I said before, a 'pay up or were sending bailiffs on the xx' letter may well give the manager the kick up the !!!! he needs at the price of a first class stamp.

    I was planning on doing that if he didn't pay up by the deadline which was yesterday. The thing is, he is a very difficult, stubborn piece of work and thinks he is above everyone. If I tell him that we are planning on sending the bailiffs in then he'll come back with some sort of reply saying that he has no intention of paying. Does he absolutely have to pay now that he hasn't disputed and missed the judgement deadline?

    Of anyone has any tips as to what to put in the letter apart from we'll be sending the bailiffs then I'd really appreciate it!

    How much is the claim for? If over £600 you would do well to apply to transfer the judgment to the High Court for enforcement.

    I'm still a bit confused about you saying you have sued the company and the hotel.

    Why not post who you named as the claimant changing the names if you like (not that it really matters). e.g. XXX Limited.

    The claim is for £500.

    We are confident that we have sued the right people as we did everything on the advice of a solicitor and CAB.

    Make it short and sweat.. something like the following..
    Date: XX/XX/XXXX

    PAYMENT REQUIRED FORTHWITH

    Dear [Hotel]

    We have now obtained a county court order for the sum of £x and require immediate payment of this. I have included details of how to make this payment at the bottom of this letter.

    If payment is not made with 14 days we will instruct county court bailiffs to attend your property on B]Saturday [/B][day] [month.

    With Thanks

    [you]

    [bank details and/or address for cheque payment]

    Somebody else will know more, but I believe there is bailiffs and a sheriffs office and the latter preferable as bailiffs can be toothless. (from what i've read that is, somebody else will know more)
