o2 cancel upgrade in 14 days?

hi i been with o2 for 6 years and my renewal was on the 1st may . but i only upgraded on the 15 may to an iphone 4s . to unlimtied minutes for £41 pcm for the next 24 months . but tesco selling sim only deal £25 for 3000 minutes for 12 months,

am i within rights to cancel (dont need phone) , get pac code and port over to tesco?

    I think upgrades are exempt from a cooling off period and if you have used the phone you definitely wouldn't be able to cancel. you could sell the phone and that would give you a reasonable amount to offset the extra cost of having the handset.

    As above, there is no statutory cooling-off period on an upgrade-only what the retailer may (or may not) offer.
    No free lunch, and no free laptop ;)

    It's 7 days at O2 for over a phone upgrades.

    TBH, it is not very clear what they mean:
    How do I return my phone? You can return your phone to an O2 shop or over the phone.

    If you are upgrading in an O2 shop, we’ll ask for it then.

    If you upgrade over the phone, you have 7 days to return it. We’ll send you a jiffy bag to return the phone. You should send it back to us in that, using registered post.

    Yes, please return to the store with your proof of purchase and they'll arrange for your upgrade to be cancelled or to upgrade you to a different handset. If you changed your tariff as part of the upgrade you'll still have to pay for any pro-rated line rental amount and any charges outside of your allocated allowance.

  • if you upgraded in a store you have no right to a 14 day cooling off period as you do if you order the upgrade over the phone or the internet.

    lol well yesterday walked in , gave phone back and got refund although iphone 4s was opened / seal broken / phone activated .

    then when i was about to cancel they give me 12month contract, 26 pcm for unlimited cross network mins/ texts + 1gb data. :) - just no free phone so im using my old iphone4

    the thought of being roped into a 24month , 41pcm contract . phew!
