VCS/Excel do seem to be upping the anti at the moment there must be some method in their madness? As even a win will be a financial loss, they must be desperate for the success stories.
However it does not seem to be going too well for them at the moment!0 -
There is absolutely no reason why even in the lower tier judges should not take heed of and be guided by rulings made by their colleagues elsewhere, even if they are NOT binding precedents. After all, litigants are entitled to have some confidence in the ability of the Court system to deliver judgments which are consistent in their application of law.
I have been coming across a particular vexatious litigant who continues to press cases based upon identical facts to previous cases in which judges have thrown his claims out as being bad in law.
This appears to me to be an abuse and a contempt. Once you have been told a case does not stand up, you either accept it or appeal it. What you should not do is just carry on regardless and force other defendants to rebut groundless allegations.0 -
Have VCS/Excel ever actually won a case? (other than a default judgement).
It seems this bunch of bozos would struggle to organise a drinks party in a brewery. No wonder Freddy Kruger is trying to deflect attention from the many red faces as they take stock of another legal loss.0 -

They did do that well publicised article in the Sheffield Star warning that they would be ensuring that there was no hiding place for non payers.
Unfortunately, it seems to have somewhat backfired on them. As soon as we can get the fuller details of the case it may be worth getting a transcript of judgment. That will help in answering the queries raised by our friend freddy, too.
Freddy, where do your affiliations lie in the field of private parking? Do you feel that companies that rip off the disabled, elderly and unwary for large amounts for piffling contraventions (or non-existent contraventions) are good or bad? Don't sit on the fence!0 -
None of us know what the Judge said or why he said it (in relation to the conduct of VCS/Excel or otherwise). Therefore we cannot say that anything has been misquoted, especially when the person who was in the court is apparently giving us the information. None of us were there, so it is futile to speculate as to what may have happened other than VCS/Excel having their !!!!!! handed to them again. If it is possible to get a transcript and see exactly what went on I would be very interested.0

You have to ask yourself why "freddy_miles", who says he has no connection with the private parking industry, specifically registered on this forum to comment on this topic. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

I posted in response to the statement regarding process as opposed to the subject matter, in this case parking.
I have no interest in either of the parties connected to the action.
I merely questioned the statement.
So, are you a long-time "lurker" or did you come across this thread by chance? What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

Asking if Freddy has an interest in private parking is like asking does a bear **** in the woods
Its to much of a coincidence for someone to throw their toys out of the pram over a loss by VS/Excel
I wasnt born yesterday. You can always tell those with something to hide...Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
Yep, I know the answer is fairly obvious but I want to hear it from him. Brian Clough or whatever he's calling himself this time.
Perfectly reasonable question to ask a newbie MSEer who hasn't got a signature declaring an interest but nonetheless appears to be from the dark side.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
