Cant rent due to CCJ's

    Yes of course they do! They landed in the same problem as we did when hubby lost his job as they both wotked fir the same people!!!! And I got the agent to ask the ref company before paying any money and they told me they can't tell until they run the application! Which I think is hog wash as I am sure they are not the only ones on an IVA.

    If hubby is looking after the kids while you work your shifts etc then you don;t need to go straight to a 3 bed house

    1. talk to shelter
    2. might need to be a room not a house
    3. look for private rentals bypasing agents in the paper
    4. hopsital accomodation

    All this will be much easier when you are an employed professional versus a student.

    Lindyloo... My point exactly! The problem I have is that my name is on the caravan agreement and because its old and we can't be guaranteed to get much for it the ex won't buy me out. So we agreed that he would give me my deposit for my new property and half the value of all the furniture. This totals £1200 which is what I am using to try and move. So effectively I can say this is buying me out and hand the caravan over into his name. The council are arguing if I do this I am making myself homeless and therefore won't help me!!!!!!

    But if we both sold the caravan and had an agreed date of the new ownership they would!!! I mean what is the difference??? Grrr :mad:

    The worst is I'm not looking to sponge off the government!!! I have studied for almost 4 years now!!!! as a mature student it has not been an easy task... But I'm nearly there! I have my first interview for a registered nurse post on the 30th May... 10 weeks left of practice and one dissertation due in June....

    But yet I get kicked in the teeth!!!! This country is backwards! It seems the more you try help yourself the less support you get to get back on your feet... But if you become lazy and sit around and do nothing, you get all the help in the world! :(

    I am afraid that the council is bound by very strict rules as regards homelessness and have to go through various criteria to decide whether whether you meet those 'criteria'.

    One of them is have you made yourself 'intentionally homeless'?

    The fact that you have received money for 'leaving' then you would be making yourself intentionally homeless. I know it seems ridiculous, but the stark reality is that there are just not enough houses for people so the 'rules' are very tough. In theory you have sufficient money to rent privately.

    As I see it you have the following options.

    1. Try to find a private LL who will accept you with your poor credit history.
    2. Ask your ex to leave the caravan and you have it with the children until you are in a stable job and have sorted out your debts. (far easier for him to find somewhere to live as a single person)
    3. Register on the housing list (you may get extra points for overcrowding - sorry don't know your children's ages.

    As I said before you should get some professional advice - CAB/Shelter.

    Also you need to do something about your debts. Have a look at the 'sticky' on the Debtfree Wannabe board for where to go or go to CAB for everything.

    It is important to do this asap.

    Helping yourself is making your own way in the world and not expecting others to sort out the mess you have made of it. You appear to be the architect of your own misfortune, so if you're angry I think you should be directing that anger at yourself.

    Not everyone does have CCJs, especially CCJs they appear not to know anything about. I have absolutely no idea how that could have happened. People generally know when they owe money to others and haven't paid it back.

    Mistiek - do you currently have other outstanding debts, in addition to the "mystery" CCJs? If yes, see a free debt counsellor asap.

    Check out your records as held by Experian, Callcredit and Equifax. Have you thoroughly looked into those CCJs? You say that for one of them you "weren't at the address at the time"? Did you update creditors when you moved?

    As an initial way forward why can your ex not be the one to move out, as pmlindyloo has suggested as an option?

    Would there temporarily be space for you at your mother's home?

    You can ask the local LL association for contact details for LLs who self manage their properties but they will be wary of any potential T who doesn't seem to know what has happened with their own finances and hasn't been in "settled" employment for some time.

    If you are applying for hospital jobs now to start in Sept, is there any chance you could obtain some "bank" work as an HCA across the summer as a way of upping your income whilst waiting for your nursing registration to come through?

    freaky - you obviously meant this as support for the OP but it's a nonsense.

    There are people with little or no debt, there are some with debt that they are dealing with ( to avoid being slapped with a CCJ), there are some who have a CCJ against them and are doing their level best to clear ithe debt before the court deadline and there are others like the OP who seem to have let things slide ( for whatever reason).

    There is help for those who are struggling with debt but it has to be dealt with, not ignored in the hope that it will go away.

    CCJ's can easily be added without someone knowledge as the courts do not insist on proof of delivery and reciept. IE in the US you have to be physically served with court papers so you can't say they haven't been recieved. In this country the lender/debt collector goes to court having sent the documents (via ordinary post)to the last known address and it is acccepted! Then if the person fails to repspond the court can award the CCJ-still with no proof the person concerned even knows the action is taking place.

    That is why so many people get CCJ's set aside, there are cases where they are put on whilst people are abroad, not their debt but a simular/same name and in many cases even whilst people are making payments under agreed arrangements.

    If you can and do get it set aside they will likely reapply so as the other poster said you need to pay it off straight away once its removed (if paid within 28 days you can have it taken off your report).

    Is there any way either you or ex could rent another caravan on the site where you are? Or does he have a friend or relation he could rent a room from-he could come back to see the kids.

    If you are on a camp site are there tent pitches. Could you buy a largist decent tent to live close buy and swap over to stay with the kids in the caravan when its your respective turns with them (or rent the single room somewhere and take turns with the kids in the caravan)? Not ideal by any means but it may be a way to get through until either the CCJ's are removed or dropped off or you find someone who will rent to you.

    Only other thing I can think of is are you sure is completely over or is it just the stress of the situation pushing you apart?

    Unless there is a third party involved you may find with some help you can work things out for the kids (better for you both and for them if you can). Perhaps relate or simular? Even if after that you just end up definately sure its over.

    Ok so just to set the record straight here!!!

    JJLanlord I only have 2 CCJ's and NO i did not know about them... they are both for the same property.. I got one 2007 for that property yet I was not living there... Nothing has been done about them either as I have only just found out about them this week so will need to investigate them and find out what can be done....

    Bitterand Sweet I do not expect any help.... Im angry that no matter how much I am trying to sort my life out I keep getting kicked down.

    I have taken stock of my dept and have been with a dept managent company for years now paying our dept off... I have studied for 4 years to get a better paid job that I can grow in and earn more as time goes....

    I have also left my hubby... its his lack of work and loosing his job that got us in this mess and unfortunatley he is still self emplyed and im tired of fighting for him to get a new job.

    The money I am getting from him is my deposit and first months rent. I have saved the rest over the month by pulling my belt tight. As for him moving out and leaving me the caravan well that not an option we have shared custody so neither of us is "single" we both will have them for a week at a time so we both need to have a place that can accomodate them. I would prefer a flat rather than a caravan and as my finances are more secure than his its easier for me to move (well so I though)

    When I started this thread I was just looking for some advice from anyone who has gone through the same thing... I am not expecting the governement to pay for a house etc... I have the funds to do that and will be paying my own way... Im just struggling to get in anywhere due to the CCJ's I did not know about.
