    i would of thought that your BF would of got letters regarding this as he is registered keeper and ultimatly is responsible regardless of who is driving,but not if he had sold the car before the ticket was issued and the new owner was slow to re-register the car in his name

    im afraid you do need to pay as newlyn are a bailiff company
    £125 is not bad if thats what they are asking for, normally when a penalty charge notice gets to bailiff stage its about £250

    i would say to them can i pay 50 quid now and £15 quid a week till its paid they should, i would of thought accept this as the councils normally give 3 months "life" to collect

    Emma, the figures don't make much sense and are not the normal ones. I was working on Ticket £80, 50% surcharge for not paying £40, plus £5 TEC registration = £125. Council tickets are not generally odd amounts.

    Still, wait for the result of your application to TEC and all should be revealed!

    Sgtbush appreciate you input but the OP is looking to get the warrant set aside so doesn't want to pay the bailiffs. If that doesn't work we can tell them how to thwart the bailiffs.

    Liverpool PCN's are £70 or £35 higher tier £50 or £25 Lower tier. So it looks like it may have been a lower tier, if the total now is as posted.

    Once the witness statement is done and the TEC receive it, it should stop Newlyn, however if Newlyn don't back off, don't let them into BF's house keep your doors and windows locked. If they don't get in they cant do anything! You do not have to let them in.

    Anyway, in the event that the bailiffs try it on: They are bogeymen whose bark is far worse than their bite. They try to sound scary because actually, they are quite easily rebuffed. They rely on Joe Average not knowing his rights or their powers.

    In a case like this (council) they have no right to enter your property by force. However, they can enter "peacefully"- that is, if you give them an open/unlocked door or window through which they can enter without causing damage, or allow them to come in.

    The problem is, that if they have once entered peacefully, that then confers upon them the right to use force on subsequent visits if uou refuse them admittance.

    So its vital that they are never allowed in at all. It is best to put a chain on the door and speak to them from a window. If you can, record or video all conversations. And do not fall for them trying to trick their way in with requests like "can I use your loo" "can I just come in and phone the office" "why don't we talk where the neighbours won't hear" "can I have a glass of water" bottom line, you don't care if they are dying, they don't come in!

    Of course don't leave anything valuable (like a car) outside the house. They can enforce on that.

    Although they try to panic you by adding ever vaster fees, at the end if they realise you are wise to them, they will go away. There are plenty of other mugs they can enforce on.

    Usually, as has been said, after about 3 attempts.

    Hope it won't come to it, but like the boy scout- be prepared!

    as I have said these bailiffs should be asked to produce a warrant through the letter box in YOUR name, not a letter written by them, an actual court warrant, they claim to have and you must be named on it.
    If they can not, they are trespassers and debt collectors not Bailiffs.
    You should ask them from an upstairs window whilst filming on what capacity are you acting today as a bailiff with a correct document bearing my name or as a debt collector. they will lie and get shouty and try to embarrass you, saying let us in and we will talk sensibly, they are the big bad wolf and you are in the house of brick, done let them in.
    Demand they serve a court document through the letterbox with your name on and the signature and name of the person who signed on oath of her majesty the queen, they wont have one, they never do, tell them come back when they have.

  • Do you know what, given that it's my boyfriend's address they have got (he lives in a houseshare), I don't think it's fair of me to ask him to deal with debt collectors is it? The TEC have sent the form out, but i wont get it till Wed (boyfriend has to fill it in, everything is in his name). So now I will have to phone Newlyn and see if they can put it on hold till this witness statement is sorted - but you know what they are like, it's always a no from them, no room for compromise. I am going to be left broke paying this - that's why i begrudge paying it :(

    Boyfriend said he didn't receive a letter from TEC, as he said he was pretty darn sure he would have let me know if he did! lol.

    I do know how debt collectors work, i've had alot of years of experience and empty threats from my own debts, so I know they are just scaremongering, but i think with this one - the fact they have my boyfriend's name and address and will be visiting his house is an entirely different matter.

    Would love to know if anyone has had a similar letter from Newlyn's and how quick they turn up at your door - I only need 2 weeks grace till I can get this witness statement done :/

    Well originally ticket fine was £70, and had I of paid this within 2 weeks, would have been £35. So they are looking at the £70, and then i'm assuming that they added their own charges onto this somewhere along the lines before it went to TEC...

    your BF needs to give a third party authorisation for you if he wants you to deal with it, thats the data protection act for you, Newlyns shouldnt be even discussing the case with you apart from questions like can we speak to him, they cannot actually discus the case until they get permission, no matter how much info you know about the ticket, they cant discuss it with you
