Can I enter????

Hi All just looking for a bit of information as my Landlord association has not been able to get back to me.
We went to look at our property and noticed that the condensation in the bathroom had gotten bad as the tenants had not bothered to clean it.
We went into the property and cleaned it and decided that it really needed painting with a mould paint or something.
Anyway we have contacted the tenant about arranging this and they are not getting back to us.
I really want to get this done as it does not look nice someone has told me as long as I give the tenants 24 hours notice I can enter the property whether I get there consent or not. To me this does not sound right and I would not like this, however we are putting the house on the market soon and I want to get it done as it looks so bad.

Any help would be appreciated.

    If you are going to put the house on the market soon you would probably be much better off selling it with vacant possesion. i.e with no sitting tenants. You might want to consider moving them on and painting and decorating once they have left. It's not causing damage as such so I wouldn't worry about it and just wait until the tenants arrange a convenient time for them.

  • Thank you for your advice I was thinking about that being the plan however we would like it to go on the market and for us to sell it asap as we dont want to be paying the mortgage without making any money. How long does it take a sale to go through after an offer has been excepted? When we brought our property it took 4 months!!!

    1) you must inform the tenants before going in. And if they tell you they don't want you on that day, or that time, or that week, or ever, you canNOT just ignore them.

    2) Do not waste your time trying to sell while the tenants are there. No serious buyer will be interested, and the tenant can in any event refuse buyers/surveyors etc access

    How long? With tenants there it could take for ever....!

    Serve the appropriate notice (are they on a fixed term tenancy?), wait till the tenants leave, then do the place up and put it on the markt.

    Could take you 4 months to get the tenants out if they don't want to leave when you find a buyer! No-one can exchange on it with tenants in place as mortgage would not lend until its vacant.

    So if you are looking for a quick, hassle free sale, get the tenants out, refresh/redecorate as necessary and put it on the market empty.

    Won't take more than a couple of days to paint the bathroom surely?

    Plus, if you have proof that the tenant's negligence has caused the problem, you can claim the cost from their deposit AFTER they have gone. You cannot do the work now, then expect them to pay for it when they leave.

    Well surely they got back to you for you to go in and look at the condensation, so why would they not get back in touch for you to go and repaint it. Could you not have arranged a time with the tenants that day whilst you were round?

    Well that was kinda me fishing. If they DID do that then why are they so fussed about doing it again... ya know, despite the fact its insanely illegal etc...

    Emergencies? "Sorry, officer, yes I could smell gas/I could see water pouring through the downstairs ceiling/I could see flames leaping out of the windows, but I couldn't contact my tenant to give them 24 hours notice of me entering to investigate."

    Well, apart from questionning why they were snooping around so close as to notice those things, most of them will be obviously not true except the gas one.
