i have been with my ISP for over 18 months now. and was only being charged £27 a month for unlimited use. 8 meg down. anyway i normaly download about 140 odd gigs a month. last month i looked at bank report and i see they have started to take out a dif amount. ie £145 a month.
i called the ISP and asked what the **** is going on. they said you have reached you limit and you have been charged for every gig ie a £1 a gig.
i said what the hell are you talking about a £1 a gig for using over my limit i dont have a limit. they said yes you do we sent a email saying we are changing the price of net.
well i never got this email so dident know about it.
so whan i called and found this out i went mad.
you cannot do that i said i havent been told.
yes you have they said we sent a email we can prove it. and we have your money and theres nothing you can do about it so tuff. and that was the words he used.
i also told my bank this story cos of the money going out.
bank have told me not to worry you will get your money back we are taking them to cleaners for you. i was like no way are you really?
they said yes they cannot do that leave it with us.
So I want to know is email really good enough for written notice? legally does it stand up because it's obviously not secure or reliable, I promise I never recieved this email.
Do I have a case?

Not sure on how you stand regarding the legality of an email as notification but the first thing I would do is request a MAC and migrate out to another supplier as if your bank reverses the payment then it's quite likely they'll cut off your broadband.
For £19.99 per month you can get up to 8Mb with a 30 GB peak ( Monday to Friday 08:00 to 22:00 ) and 300 GB off peak limit with UKFSN0 -
10.1.6 If you use the Services and/or Equipment otherwise than in the course of a business,
trade, profession or occupation, we may increase the amount payable by you for Services and/or
Equipment by giving you one month's notice in writing.
This is in my terms and conditions, surely 1 months notice in writing does not cover an email with immediate effect?!0
