    Thanks for all the responses on how to deal with these scum, they can't carry on going round operating like that, roll on oct.
    I got clamped once before (same reason) they used to leave it clamped for a day or two, gave me time to pop off the tie rod end get the chain out and get the clamp off. Never heard nothing. wish i saw it this time.

    No, in October.

    At peteq, if the lease says nothing about a permit scheme, then the Building Agents need to vary the terms of all the leases before they can begin operating a scheme.

    I'll bet my mortgage that they haven't.

    Find the exact wording of your lease re parking from the landlord, or find another owner-occipiuer in the development.

    If you havent already guessed you need to check the lease agreement urgently.
    then it should be a simple case of putting a claim together to both the management company, and the clamping/towing company.
    Before you do that, and if the lease agreement doesnt mention anything about permits/clamps etc try calling the management company and asking for a refund plus your costs for the clamping/towuing as they are jointly liable for tyhe actions of their agents, adn as such they should refund you just to see what they say.

    This should be an easy case, and you will either get a refund form the clampers ( unlikely as most of them collect CCJs by the dozen) or form the management company, who have much much more to lose.

    1. Check your lease
    2. Call the management company to see what they say about a refund, state that they are jointly liable for the actions of their agents ( the clamping company) and as such they should refund you your money+costs without delay, otherwise you may be forced to take action to recover your losses.This will probably be unsuccessful but it will give you an idea of how they will react
    3. submit a letter before action to both the management company and the clamping company - someone will give you better advice
    4. keep us updated on your progress

    It has been, but one set of scammers (the Government) paid its respect to another set of scammers by delaying the start of the ban until October. A bit like "We are making burglary illegal, but not for five months, so just carry on for the moment".

    Why the hell have the management company got scumbag clampers in that case ? Nobody but residents can get in there. Sue them and the clampers, you will win.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?
