Hi guys, i was driving my wifes car yesterday, she was with me,and we parked in a car park belonging to a clothing retailer, and unbeknown to us the p&d ticket got blown off the dashboard onto the floor, still visible and face up showing times etc, we got back to the car with 15mins to spare, and found a ticket on the screen, It was written and timed for the exact time we got back, and the patrol officer (aka as gestapo) was several cars away, obviously when questioned about this he said "nothing i can do, appeal" and walked away.
Now he has written the code down as 01 =no valid ticket on display and has also hand written no ticket purchased,( which is another code) If he had bothered to take a closer look he would have seen the ticket, i know it is my responsibility to make sure the ticket is visible, but presumably when i shut the door it blew off (an act of God) Now my wife is panicing and wants to pay the £40, but i am of the opinion they cant enforce this without going to court, and im not going to pay. I will be expecting the threatening letters to arrive when we ignore the ticket, but i am very willing to make this public to name and shame both the store and the parking company, Am i within my rights to do what i plan to do as regards paying, they do not know who was driving, and presumably they will have photographic evidence, as to the ticket not displayed correctly. Dougie- this is simply a scam. First off, you paid, you have the ticket as evidence. Second, when you pointed that out to the goon, he could have and should have torn his ticket up. He tells you to appeal because he knows they will turn you down.

You owe them absolutely nothing. Do not waste time or effort trying to argue about it, just completely ignore them. After a flurry of idiotic letters they will give up.

As you rightly say they don't know who was driving and no-one has to tell them.

Just laugh at the fact that their efforts to rip you off will end up costing THEM money in the fee they pay DVLA for keeper details, and postage.

Also, tell all your family and friends, never to take these fake private tickets seriously!

Which company was it as a matter of interest?

Agree, though from the amount demanded and the statement that it was a private car park I gathered it was a PPC.

Town and City will never take you to court anyway; but, if they don't know who was driving and you paid your parking fee, the possibility diminishes still further.

There may be someone arriving shortly to give you contrary advice, but he's from Billy Smart's too, lol

TCP may be as morally bankrupt as any other PPC, but they don't do court.

However, this isn't out of altruism. They know that enough of their victims just pay up, and that a blackmailer couldn't sue their victim if they didn’t pay.
