Is there any possibility that the vehicle can be returned to the garage and if so what is the cost likely to be?
Alternatively you need to speak to a specialist motor broker and explain that your aunt has purchased a vehicle for your use but the vehicle is registered to her as it is on finance.
They may be able to find an insurer prepared to issue a policy in your name, noting your aunt's interest on the policy as owner and registered keeper of the vehicle and santander as the finance company.
Your aunt as vehicle owner should purchase gap insurance - not sure what info has to be declared but if there is anything on drivers she must inform them you are the main user.
In the event that you are able to achieve this, the best advice to you must be to save hard to pay your aunt off and she can then transfer the vehicle over to you which will simplify things.
Unfortunately I don't think you have a leg to stand on regarding what the garage told you - they don't make the rules for the finance company - it is up to you or the borrower in this case, to check everything out prior to signing anything.
Whatever your aunt does, if she ends up having to insure the vehicle in her name, she must tell insurers that you are the main user.
I would also not be too bothered about going and ask the garage to store the vehicle particularly as you believe they have caused part of this issue.0 -
thanks to all replies, the complications are made worse with me and aunt being at different addresses, would not have been as much of a problem if we had been mother and son or at same address. guess you learn by your mistake, still think buck stops with bristol st for giving me totally wrong info will never use them again am thinking of cancelling car and asking them to come and pick it up as there was no mention of all this on anything that was given to us or signed for. they say the main agreement will be posted out to us soon too late!0

Just one point from the bits on the internet about Sandanter Consumer Finance's (SCF's) T&Cs there is a statement that the SCF retain ownership until a transfer fee is paid with the final instalment. On that basis SCF are the owner, aunt is the RK (could also be useful to include her as a named driver) and you will be the main driver and policyholder.
This does concern me as it is 99.9999% certain that somewhere the agreement your aunt signed will have a statement saying that she has read and agreed with the T&Cs. Was anyone with your aunt when she signed? If you do get insurance sorted to be fair to your aunt you and her should really sign a separate agreement between the 2 of you. The agreement between SCF and your aunt places a liability on your aunt to "provide insurance" (we don't know the exact wording) and the agreement between you and your aunt will effectively transfer that liability to you. Unusual for car insurance but not in other areas of insurance (e.g. construction contracts) where such a liability can be passed on 2, 3 or even 4 times.0 -
If your not careful your going to land your/his? aunt with a large bill even if you return the car.
Bills paid, work done so charges will apply.
Worst case is they take the car back at trade in value. Which could be £1000 less than you paid + charges.
Failure to pay may see debt collectors knocking on her door. They may even take her to court for it.

Thanks but had checked with bristol street and santader and they had said i had 14 days from signing to cancel and they would even refund deposit (£149) that we paid think that was why they chucked in free tank of fuel and free servicing. the manager just kept saying sorry for all the mistakes and said salesman had only been there 7 weeks. I told them i was not happy and will be sending letter to head office the salesman should have been properly trained, bad enough being told 1 wrong piece of infomation but everything was incorrect and has caused a lot of stress. Anyway just to let you`s know keeping car got great insurance deal only £2818 (deposit £563.60 plus 10 months at £268.21) with £500 excess but payed £75 for excess protection so if you need to claim you pay your excess then get it refunded within 7 days.Aunt is down as owner and registered keeper and son as main driver with aunt as named driver. I know it may seem expensive to some but nearly half price of any where else even if i had put all details in sons name. Can reccomend crosby insurance they have been great and thanks to everyone for their help. have checked everything with santader and they say its ok so i am very happy. x0 -
Most of the times it as it happens that the person under whose name the loan is registered, the car will also be entitled under his name. The other thing is that, if a person buys the car for self use, but under any other's name, then every time he has to carry out the paper works mostly of that person. This sometimes may also cause some consequences. The better option would be to wait for the time when all the things like insurance, loans etc can be under the name of the person who is willing to but the car.Be insured and be safe0
