    As anyone actually got a copy of Santander Consumer Finance's Terms and Conditions as they do not seem to be available through the website? The message I keep seeing is "Terms and Conditions will be supplied when the completed Agreement is sent to you." This could mean that you are sat in the showroom with the salesman holding out a pen and that is the first sight that you have had of the T&C's. So was aunty a) advised to read the T&C's? and b) given sufficient time to do so?

    Although the owner and registered keeper can be (as far DVLA, etc are concerned) different people (or legal enities) Santander's T&C's could override this. IMHO the real issue is whether Santander's T&C's refer to both the "owner" and "registered keeper"?

    To the OP: as there is the issue with continuous insurance, etc could you not ask Bristol Street Motors if they would store the car until your aunty returns from holiday. This would give time to sort everything out without possibly spending more money than you have to.

    They would not loan because they are better judges of circumstances and characters than family's.
    The cuts an austerity measures are only 5% complete, job losses galore are on the cards and they obviously rate your aunt in a much stronger position to keep paying if the lad looses his job, that and the aunt will have some assets they can go after.

    PS You will need some GAP Insurance as well, for if the car is written off you will be lucky to clear half the finance bill with the insurance companies settlement, the other half will still need to be paid and this leaves the trap of paying years of finance and not having the money for another car, this is where gap insurance fits in, it pays that gap and with over valued finance cars it can be huge.

    thanks for your reply dont really want want to contact bristol street because of all the incorrect info they gave me (they only offered me a full tank of petrol and a free service) but will give them a call. Thanks for being much nicer and more helpful than "forgot my name"
  • If finance company want car in aunts name then that's what it's got to be. It's still their car!

    Most insurers will allow you to select a different registered keeper to the main driver - just call them up.

    Admiral certainly do for our cars as I am the registered keeper for all three. I'm the main driver for two with my wife as a named driver and for the other one my wife is the main driver and I am a named driver. Before switching to Admiral I had 2 policies with DL, 1 for the family car and 1 for my wife's car and my wife had a separate policy with the Post Office for my fun car.

    This is totally different to the OP's situation. There is a legal entity between married coupled, but nothing between parents and children or nephews and aunts.

    Aunt legally owns the car. Nephew insures the car and writes it off. Insurers can't pay nephew because he doesn't legally own car, but they can't pay the aunt because she isn't the policy holder.

    I can promise you none of the Admiral companies will entertain this.

    I'm sorry but my experience is totally different. I bought a car a few years ago that I left with my son in Scotland for when I was there on business but that he had the day to day use of and the declared insurance details were:
    Owner: me
    RK: my son (I didn't want any parking tickets, etc)
    Main Driver: my son (as he had day to day use)
    Named Driver: me (for when I needed it for business use)
    Policy holder: my son (not the declared owner but was the RK)

    Did have to sort it out on the phone as the on-line application couldn't cope with it.

    Parent and child you might just get away with, especially when child is the registered keeper.

    Aunt and nephew where nephew's name not on paperwork. No c0cking way.
