LloydsTSB problems.

I’ll be brief as I can.
My partner and I have a joint current account with LloydsTSB. They then, for whatever reason, moved our current account over to a select account without asking us. Also, we have never signed any paperwork authorising them to do so, so this was done without our knowledge, or permission. This new select account we were moved to, has a monthly charge of £7; I think it that has now risen to £10 per month. When we challenged them about it, they said we gave them permission to do so, and would produce the necessary paperwork as proof. We then waited for around 3 to 4 weeks, and a letter arrived from LloydsTSB stating they could not find the paperwork as it was a long time ago. They then said that they do not need paperwork to move accounts, so they contradicted themselves already in the first letter. They also tried to blame us for not noticing that our account had been moved!!!
They said we should have noticed the money going out of our account every month, and told them about it. Sorry, but if they hadn’t moved our account and unlawfully taken money from us, we would NOT be in this situation. To me, this is the equivalent of stealing from a person’s wallet over a period of years and when caught, complaining that he should have noticed it years ago.

They have offered me 3 goodwill payments over a period of time, which have got higher by the letter. I have refused each one of them. The account is now seriously in debt to the tune over £1500, due to bank charges incurred by this monthly fee that LloydsTSB take out every month, and they are now harassing us with 2 debt collectors on a weekly basis. The debt has occurred because we decided to bank elsewhere, as they were being very unreasonable about the situation, and the debt grew out of the bank charges due to this select account monthly fee. I have told them I would like every penny back they took from us without our permission, which is estimated at around £2000, and the debt removed. Their top offer was a £600 goodwill payment and the debt stays as is, with their debt collectors hounding us weekly.

That about sums it up. I do not know what course of action to take? There debt collectors are hounding us on a weekly basis, but have not said anything about going to court.

The select account has not been available for at least 6 years now so you've had the account that long and never noticed the charge? Come on...?

Why would you let the account get into debt to the tune of £1500. If the account and fees were an issue would you not have sorted it out long before it got to this stage.
I find that strange but then Im slightly obsessive on monitoring my balance.

Really? Cos I was still on it in 2010. They, LloydsTSB, moved me back to a current account after 3 rounds of letters in 2010.

No, we never noticed the charge, both our wages were being paid into this account, so £7 was not missed that easily.

The account ran into debt because we opened another account at NatWest, and told Lloyds what we were doing, and why. The debt is soley down to the select account monthly fee, not a result of overdrafts, unpaid DDs, etc.

Sorry, but even if there was a £1 transaction on my account that I didn't realise, I'd be contacting the bank kicking up a stink to find out where it came from and why. Fraud typically starts with small test payments and then ramps up if you don't notice, so I check every transaction. Doesn't take long once a month. The cost is currently £8.95, a figure that would stand out to me.

You most likely had a letter through the post saying your account was being 'upgraded' to a select account unless you ask them not to. If you ignored that letter, you would have been 'upgraded' automatically.

Would it not have been advisable to close the account as soon as you realised you were being charged a monthly fee and then chase a refund from the Bank?

Instead you've decided that you didn't like the monthly fee so you've moved accounts and just let it run deeper and deeper into the red.

I could have the wrong end of the stick,

May be I misunderstand something here - but if the debt of £1,500 (or is it £2,000 - - can't really tell from the OP) is due to a £7/month charge (and interest plus charges on it), that £7 must have been going out every month for a long time There are no dates in the OP, so we can only guess that it was over a period of several years.

It's very hard to believe this could not have been noticed, and corrected, a lot earlier.

You misunderstand. As of at least 6 years ago, it is not possible to upgrade to Select (it was replaced by Silver) so your account must have been upgraded that long ago and you must have been paying the fee for that long.

A £1500 overdraft caused by an £8.95 Select fee a go means you were paying it for nearly 14 years. More if you were paying £7 at one point.

I'm sorry but your story doesn't add up. If you do indeed owe £1500, unplanned overdraft charges must play a part. The select fee is an account fee so won't be returned and will caused you an unplanned overdraft when debited. You seem to have washed your hands of the account so under the current charging structure, you are probably being charged £10 a day up to 8 days each month.
