insurance accident settlement?

My daughter, and sister (driver) where involved in a 3 car collision a couple of weeks ago, a car hit the rear of my sisters car (stationary at the time) sending her into the back of the car in front (stationary at the time) which was behind a car waiting to turn right. This resulted in my sisters car being a write off. Both my daughter and sister sustained injuries of whiplash, and soft tissue injuries, for which they are receiving physio. They have now been offered a figure for settlement in full for personal injury. This will result in them no longer being able to receive the physio they have been offered. My daughter has been told she will need several sessions due to her injuries.
Should they accept or hold out till after their treatment?
Is this what the insurers do? offer a payout in the hope it will be accepted at a lower value?
Both my sister & daughter are far from recovered.
Thanks in advance for any advice

Im a bit confused, if those injured in the crash require medical care (in this case physio) surely they would get this for free on the NHS?

If that is the case why would they be getting or need additional monies ontop of those due for the damage to the car?

All the physio, personal injury claim etc was arranged through their own car insurance, when they notified their insurance company of the accident.

It looks like you are dealing direct with the third party insurers??

If so, get your own legal advice/representative to deal with them. They have a massive conflict of interest - and offering a final settlement so soon is taking advantage!

thanks for the reply, my daughter and sister are not dealing direct. Soon after the accident they received a phone call from this company saying they had been instructed by my sisterrs insurers to act on behalf of my daughter and sister with reference to the accident.

Sounds like the insurer sold on the victims details - the victims should be doing the intructing, not their insurer!

They shouldn't be expecting them to accept a final offer if they still need treatment!

Get them to speak to someone at the firm (are they solicitors? If so try and speak to the solicitor dealing with the case) and voice concern.

The company is a law company (rather not name them), this company said they could not advise on whether my sister & daughter should accept the claim, but it was an average amount offered if their symptoms where to clear between 3 and 4 weeks.
From the physio's point of view, they must be thinking it will take longer than this as they have said they would benefit from further treatment. Their medicals are in June & July, so until then they cannot get a full statement on what injuries they have suffered and length of time it will take to recover completely.

But their symptoms haven't cleared! They should wait till they are all clear! (Unless some other reason they want money now).

my thoughts exactly. My sister I think is a little apprehensive.
I know there is a lot of accidents these days where people get a small bump (sometimes planned) and go ahead and claim whiplash injuries etc. Also I think many insurance companies treat all deals the same in the early days in order to windle out the (so called fake claims, ones set up), and maybe offer the minimum amount of X amount of pounds for injuries that should be recovered from within 4 weeks. My son had a head on collision (he was a passenger) the car a write off, and after his medical the doctor expected him to recover from his injuries and symptoms within 6/7 months.

Don't let her feel forced into accepting this. (The only advantage is to the lawyer who will get his fees earlier than if she waits to see if/when this clears up)
