Granite worktop - unexpected cut

A granite worktop was ordered from a previously trusted firm with payment in advance. The dimensions are 2.6m x 0.6m. Nothing was put in writing but a single slab was expected. To our horror, the slab was supplied in two pieces (each 1.3m long) which doesn't look as good, no matter how good a joint was made.

The supplier said it was for ease of delivery, but larger items than 2.6m x 0.6m have been carried into the home before, so we can't accept that.

What can be done? Is it so unreasonable to have cut the granite (without asking, or discussing) that we can pursue the supplier for replacement, or would you say we don't have a leg to stand on?

    of course you have a leg to stand on
    they didnt deliver what you thought you was getting.
    regardless ease of delivery, its there job and they offer the product.

    Reject it as being not to description.

    It is a way of getting the worktop out of material which is not large enough to cut the required piece out of. It is cheapskating, no more, no less - and the excuse about ease of delivery is a smokescreen.

    You didn't ask for 2 pieces of granite 1.3 m x 0.6 m did you?

    Joints need to be supported, so how did they know this 'necessary' joint would have support?

    Really they should have sent you a confirmation of order including a diagram of what they were going to produce, then you would have spotted the problem prior to cutting.

    Problem is tha because you just did it verbally, there is no document or diagram to refer to. You asked for something and they have provided it. What you thought was going to be provided wasn't what the supplier thought was to be provided. It's one persons word against the other.

    As you have already paid in advance and have nothing in writing to confirm what was requested/confirmed, I'm not sure you do have a leg to stand on. It's your word against theirs.

    You may end up having to take them to Court and, even then, it's only worth doing so if you can prove two slabs would be no use to you - i.e. any join would be unsupported and, therefore, no one in their right mind would order two slabs.

    Lesson - always confirm in writing was is agreed between two parties in a commercial transaction.

    True Phill99 but I think it shows a lack of professionalism on the part of the supplier for not sorting this out prior to fabrication. After all they are the supplier they should know what they are doing and the customer asked for 'a' worktop 2.6 m x 0.6 m not 2 worktops!

    I could understand it if the customer had asked for a worktop 3.6 m x 0.6 m as granite slabs generally are 3 m long. But even if they had, what lengths would the company of supplied? How would they know the joint would be over a carcass side?

    Na it sounds like a company just not checking.

    oh come on this is ridiculous. there's no way anybody would expect to receive a 2.6mt worktop in 2 pieces.
    if they are not willing to replace this with a single piece of granite i would take them to the small claims court. unless of course the OP paid an obviously 'too cheap' price. (how much did you pay for this granite?).
    it would be like buying a carpet and the company fitting it with a join down the middle of the room. it's totally unacceptable.

    If you paid by credit card, raise it with them, you haven't got what you ordered, which was one slab 2.6m long.

    I'd say that the OP has got two offcuts too.

    If a 2.6m top is ordered then that's what is expected. Otherwise the order will be specifically for two worktops at 1.3m each

    Reject the tops straight away, don't do anything with them and make them available for collection

    At the risk of appearing picky there is no such thing. Hearings are usually allocated to the small claims track if the claim is less than £ 5,000 but it all takes place in the County Court. Small claims is a process not a court.
