    I'm going to the citizens advice bureau in the morning try and get someone to have a look at the conflicts in the documents.
    And hopefully see if i am right with my opinion in me not paying.

  • Rang citizens advice this morning, they passd me to the FSO who are going to look into the matter. So its in their hands. To solve the threat of court action etc i will write to the broker and tell them that i will fully co=operate with the desicion the FSO draw on the matter and if i am due to pay i will send their money. After re readin the letter i received if i offer a promise to pay they wont ask collectors or courts to act

    The FOS wont get involved unless you have gone through the internal complaints proceedure. You cant jump to the FOS bypassing the company's own complaints dept.

  • It wasn't my intention to go straight to the FSO i was just following the citizens advice's advice.
    They seemed happy to look into it so i'll see in the next few days as to what comes of my phone call to the FSO

  • Received mail from FSO including a complaint form.
    I still need to deal with the firm first though. My phone call for helpfull advice spiralled a touch....
    Anyway i think this could drag out for a while. The mortgage firm is charging daily interest on the amount supposedly owed so if i'm wrong in my claim my bill could be much higher. The FSO say if its paid or unpaid they will look at it in the same way.
    So i think i'll pay to avoid charges and try to claim it back because if my claims unsuccesfull i don't think i'll be able to afford the extra charges?

    What are peoples opinions of this?

    If anything i've learnt an important lesson about brokers through this and i'm pleased i found a very good broker who was fee free and whole market etc etc who dealt with my most recent mortgage.

    Obviously, we havent seen the docs but I wouldnt pay. They are scaring you into paying and that is wrong. This is what most of these types do.

    However, whatever you decide, do please keep us informed of what happens.

  • They are scaring me ino paying.
    I dont want extra charges and i'd say i'm only 75% confident on winning. Also My other half would rather i pay up and deal with it from there. So its a really dificult one. One i realise is up to us to decide on the best action.

    Probably have to have a really good chat about it tonight.
    If i was due to pay and had to pay extra charges could i avoid them due to the issue being under dispute?

  • Heres an update....

    We decided to pay the fee. They scared us into it. Although i feel a weight lifted off my shoulders as i'm no longer fearful of charges and court orders etc.
    Have written my letter to thier disputes team and i am posting it tomorrow with copies of all correspondance between myself and the broker along with the conflicting IDD's. So its sit and wait time now. The only thing is, i reckon now i've paid they wont be so quick in trying to clear up the issue.
    Had to pay though as i would have been worrying myself to an early grave.

  • Got a questionnaire sent back for me to fill in. Pointless as it seemed directed at an endowment complaint.
    Filled it in best we could and sent it back to them with a short letter telling them that i felt the questionnaire wasn't relevant and i enclosed a copy of my original letter to them.
    Now sit back and wait to hear further

    thanks for update.

    There isnt a need for a questionnaire as its not the advice you are complaining about but the disclosure and enforcement of a fee.
