Argos PPI rejection, advise please

I sent off a questionaire to Argos Card regarding the insurance I had been paying on it. I rememer speaking to the lady, who wouldn't take no as an answer and went on and on until I agreed.
Now, Argos have rejected my claim for mis sell, they say that 'Coversafe was sold an a optional insurance product to protect your Argos Card Account during a relaxed, non pressured conversation. At no point during the call was impression given that the cover was compulsary. Your explicit consent has been given for Coversafe to be added to your account.'

It also says that 'when the sale concluded, full policy documents were sent which detaild the benefits and exclusions of the policy and right to cancel, and a summery of the conversation was provided that was sent immediately after the sale.'

I do not have my original agreement or any documents regarding coversafe, so do not have this to go back on but I definately remember this woman just not taking no as an answer.

My question is, what do I do now? Do I write back to Argos asking for copies of the conversation I had?
I have also now realised, that my employment at the time was only on a temporary contract, so I do not believe that I would have been covered anyway but I didnt realise this when I first made the complaint.

I really don't know where to go with this now, the letter states that this is the final responce from Argos.

Any advise would be gratefully received! :(

    Reject the reasons they rejected, ask for proof that the conversation was "relaxed and non pressured" put about the temporary contract you were on.

    Thanks for this, so I just write back to them, stating that I reject the reasons they have given, and ask that they send me evidence of the phone converasation that took place? :o

    i did that with argos and got a standard letter saying they stand by there origional responce i have now taken them to the small claims court they are now saying they are highly embarassed and are now wanting to settle out of court i got no joy till i went down that line.

    Wow, really. I really didn't want to have to go that far! Are they really that awkward! I'll give it a try, and see how I go :eek:

    yes they sent me back a standard letter i asked for a copy of the telephone conversation as i was told i wouldnt be accepted with out ppi as i worked part time. they ignored my request and sent back a letter 2 days after recieving my letter saying they had looked into my complaint carefully and stand by their decision im dealing with their solisitor now

    I just got an almost identical letter in today as you did, I too remember having to call to confirm receipt of the card, as with any other credit/store card, this is their opportunity to sell PPI.

    As the insurance was sold via a telephone conversation from a member of your insurance team, I require a copy of the recording of the telephone call made to myself on XX XX XXXX.

    I feel under the circumstances I would like an independent party to investigate my complaint and will require the above recording before I submit my complaint to the Financial Ombudsman.

    I have included a Subject Access Request with the appropriate fee in this letter.

    Please supply me with a copy of all information your company hold on me regarding my account number above. Please include all details of payments to and from the account. I also require the actual recording of the telephone conversation between a member of your insurance sales team and myself on XX XX XXXX. A transcript will not be acceptable.

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, I hereby request that you supply me with any and all historical data in your possession which relates to me and I am entitled to under section 7(1) of the Act.

    Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

    I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties against me or collected monies to which you were not entitled, then I shall be reclaiming them and also the enclosed £10 Data Protection Act subject access request fee.
