RBS phone insurance

I might have to claim for my phone having accidental damage, with RBS (homeserve) and it is covered. The problem is that the phone was a gift from a family member, their contract was renewed and they did not want the phone.

I have registered the phone on my insurance, but the terms say that they need proof of purchase and you have to be the owner. I can see them rejecting my claim as it was a gift from a family member.

Any advise would be great.

    Would they not think that my relative have broken their phone and i'm claiming on their behalf? Just checking as I know insurance companies will do anything to get out of it!

    Why not ring them and ask? If you can get your relative to sign something that they gave it to you as a gift? I don't know where you stand on this. I cancelled my Lloyds phone insurance for the same reason, as my old phone was a gift from partner.
