I dont think there would be any doubt that they could fill the places, especially for the 2014 start. I read a small thread on the telegraph site that had said retaining of deposits with such significant notice was little more than profiteering and that both trading standards and the independent schools bursars association had strongly advised against it. Other private schools locally refund 75% of the deposit, retaining the 25% for admin costs. I'm going to speak to trading standards in the am before I speak to the bursar again. Thanks for your advice.0

I think they can easily make up £350's worth of expenses. Its not a huge sum of money and I think they could easily justify it. Especially for September
I don't think even District Judges are that stupid. On top of which, committing fraud is a very risky venture, for the sake of just seven hundred pounds.The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

It would be fraud if they lied to justify the expense. If those expenses didn't actually occur it would be lying. OK let's call it an option and not a deposit. An option to take up a place at a future date.
I think £350 is easy to account for by the way. If I was the school I would be sticking to my guns.0 -
Assuming you pro-rata your enrollement costs for the year on each pupil joining that school that year. It shouldn't be too difficult.
Advertising costs, staffing costs, heat and light, IT costs, cost to cover admissions office space etc etc.
With a decent accountant you could probably exceed the £350 if you really tried.
