Faulty iPhone 4
Help!
My iphone sensor has broken. I took it to the Apple shop yesterday who said they could probably fix it by wiping the phone and setting it up from sratch but, you've guessed it, it didn't work.
They have given me a report that says that it's a hardware problem (not software).
However, as I bought the phone 13 months ago, it is 1 month out of warrenty. If I had gone to the shop a month ago I would have walked out with a new phone. As it stand, I have to pay £119 for them to replace it. I am appalled at this as I paid the full market price for the phone from the online Apple Store - £499.
Am I able to use the Sale of Goods act as it has not lasted a 'reasonable' amount of time?
Any other suggestions from anyone?
I'm very annoyed with Apple as their product should last longer than 13 months....

Not yet.
The store told me that there was no point and that they have the final say on it all. After lots of asking I got to speak with a Sales Manager (the techie one wasn't there) and he told me to claim on my insurance for it!

You need to contact the supplier (not the manufacturer) of the iPhone and request a repair or replacement under:
- Section 11N of the Supply of Goods and Services Act 1982 if the iPhone was supplied to you in conjunction with a service
- Section 48B of the Sale of Goods Act 1979 if the iPhone was supplied to you independently of the contract for service

In that case, tell Apple that they have breached Section 14(2B)(e) of the Sale of Goods Act 1979 and that you require a repair or replacement under Section 48B. Stress to them that time is of the essence because you are without a working phone. Take a copy of these two sections with you; this can often help when staff at a retailer are unfamiliar with consumer law.It was purchased directly from Apple.
