Unfortunately it will still apply - your friend could probably not give it to someone with the intention of having it sold on, and should probably have sent it back to the company.

Plus if you sell it on, you would still be trading as a business - there is no loophole making it suddenly personal items.

@Soo - which is going to make you look like a business - this will make her a business. The items have been acquired, not as items for personal use, but probably with the intention of OP selling them on. Acquisition for free is still within the definition of trading .

Thanx for advice peeps, have decided to hang on to items until my friend comes back & I will give it back to her, not wanting to complicate my life with this as I dont want to do anything wrong.
