    HappyMJ did you question the levy when it was done as the goods wont cover all bailiff fees removal fees storage fees auction fees and a portion of the debt

    who are you paying now (LOL I'm assuming its the council) have the council added the bailiffs fees to the debt (some councils do)
    when did you last have a visit from the bailiff
    Detailed Assessment Judgment of Throssell v Leeds City Council where the District Judge ruled as follows:
    “Turning to the taxation it seems to me that notwithstanding the fact that there were three liability orders but one visit was made by one bailifflink3.gif and the maximum that the Council’s reasonable charges can be is the result of applying the formula contained in Schedule 5 paragraph 2 (1) (b) of the Regulations”

    they cannot charge so many fees if only one visit is made
    as for your car how old is it? I.E. would the sale of it actually cover a large percentage of the bill anyway?
    a vehicle should only be removed if the proceeds of sale provide that there would be a surplus available to the liability order after deductions for the bailifflink3.gif fees, , removal storages and auctioneers fees.
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

    I did not question the levy. Car is 1996 P-reg. 16 years old. Dealing with council but pay the council nothing as my income is too low at £40 a week plus tax credits. The council will not write the debt off nor accept my claim for council tax benefit despite giving me £90 a week in housing benefit. They have not added the bailiffs fees to the debt. Last visit would have been May/June last year and will be expecting another one this year around May/June. They always visit twice then never again.

    send the council/bailiffs an e-mail (after there next visit you don't want to remind them its that time of year again) get a breakdown of charges this will tell you the date of the levy

    once you receive it send a letter to the council asking them to remove the car from the levy as it has no value or to take the the levy to the next stage of enforcement and remove the car (which they wont as the sale wont cover the fees)

    Rossendales are a very persistant and horrible company, please dont ignore them and pay them what you can while trying to sort out a payment plan. From what stories i have heard about them they will not send the debt back to the council.

    I am currently paying a debt off with them and they were very rude and persistant, i am currently on benefits and at first they wanted £120 a month off me but i am now set up with a payment plan with them for £20 a fortnight.

    I am there. I speak with them through the window and tell them to get off my property in no uncertain terms. I've had to call the police out on them to get rid of them once as they refused to move. That scared them off that year. They never returned. The Police were on my side as they were misrepresenting themselves (a criminal offence) and escorted them from my premises.

    They do send debts back if they declare the debt is uncollectable. Every debt I have with them has been sent back to the council.

    Do not speak with Rossendales and get a debt adviser to help you. If you are on an income based benefit you should be paying no more than £3.55 a week.

    im more than happy to be paying them £20 a fortnight. It will take less time to pay them off, whereas £3.55 a week will take years.
