CSA - Non payment of DOE Order

Again, I would ask for your case to be sent to Criminal Compliance for a visit to be made to the employers to make it clear that they must, by law make the deductions and send the money on. Without that reminder, many will push their luck as nothing happens, it just encourages them to continue. If it happens on a regular basis, it may just require an inspector to go and remind them of the penalites which they would incur if they fail to pay up on time.0

If i helps I found out who my MP was and contacted him via this site:
http://www.writetothem.com/
Just had some more good news regarding my MP, I told a friend of mine, who has also been having probs for years now with self-emp NRP and payments, the CSA were due to send in Bayliffs in Aug last year but she still heard nothing, she contacted MP (same MP as myself) giving him all the details, he then phoned her back to advised that he had contacted CSA who then told him that the Bayliff was on long term sick!!! He told them in no uncertain terms not to be so stupid and the CSA dont only use one bayliff and to get another in, her ex has his own business, two cars and two houses each of which he signed into a relatives name some time ago so as to evade this!
I really have faith in my MP and feel that this will be the best route as the MP's have a direct line into the CSA that they HAVE to answer and deal with.
Give it a go, any help is better than you having to chase them all the time.0 -
Employers have to comply with DEOs, otherwise they can be fined. Perhaps the CSA have lost the payments? You should not have to be phoning them week in ,week out.
But your MP should be able to sort this out.
Aren't DEOs supposed to paid monthly?0 -
DEOs are supposed to be paid monthly (in line with the company payroll) however it would seem that once underway, payments should reach the CSA on the 24th of each month. However, where the payroll falls say on any day after the 24th of the month, the CSA allow this as the day of the month for the payment to be made. Furthermore, many employers send the payment as a cheque to the CSA so they allow +2 further days for the post. Plus, a cheque payment has to be received and cleared into the CSA account before it shows up on someone's record as received, so this can add up to a further 5 working days. Only after all these extensions have lapsed, do the CSA deem the employer to be 'out of time'.
This is what I have been told by the CSA so of course, this could be wrong!Integrity is a dying art!:p0 -
No i dont normally ring the CSA Week in week out but once the maintenance payment is late (i was given a date of the 24th of each month) which i believe was given to me with how long it takes for the payments to process in mind! I do then ring them week in week out until i recieve a payment because as i had already stated in the above post the ex's payroll department is only available for the csa to contact regarding late payments on a monday and unless i phone to remind the csa to ring the employers on that day they dont do it! The other thing is that the payments are being deducted from my ex's wages but it is the employers that are not sending the payments through to the csa unless chased for it. (defeats the object of a DOE oesnt it really. I am currently in the process of contacting my local MP in regards to this situation and will keep you all posted as to what the outcome is if any! So thanks for the advice and wish me luck! (gotta feeling i'm going to need it! The CSA should be referring this case to Criminal Compliance to give them a kick up the bum!0

I too suffer with non compliance of DOE.. same thing.. Ex's Employers regularly hold onto the payments - often for months on end.. regardless of how many times i contact them im always told the same thing..
"We can warn them, threaten them with court..etc..or even start proceeeds for a visit to the workplace.. but the minute the employer complies and forwatd outstanding monies it all back to stage one.. phone call, written warning, courts threats, visiting threats..which means another lengthy wait.. "
and I get this month after month after month.. no matter how much I moan , ring up , complain, to the CSA i get nowhere fast.. How many chances do they really have to give the employer..?
But........ Saying that.. last few payments have come thru on time.. so something must have been done..i think..BSC Member #97- Discharged 4/2/09

I think I will give them until the 24th - the date they are advising me I should of received the NEXT payment and if still nothing then I will try that route - thanks! I've not heard of this team, wonder if they try to keep that one quiet deliberately????
I should really try to keep my conspiracy theories under wrap!
Make sure that you ask them if they have issued the correct warning letters to his employer too.....they have to do that before it can go for further action.0
