Hi all. In the house I rented previously, there was no underlay and the carpet had mildew on it. I asked the LL if I could replace it, he said yes (this was over the phone).
Predictably I guess, now that I've moved out, LL is denying we ever had this conversation and wants it returned back to original carpet and wants to deduct it from the deposit - a brand new carpet for free. Do I have any rights for disputing this? I feel like I improved the place out of my own pocket, the carpet previously was awful.

When you moved in did you have an inventory completed which you signed?
Is your deposit protected in a government scheme?0 -
Yes and yes. It's protected by the DPS."The only man who makes money from a gold rush is the one selling the shovels..."0

If he does end up getting cash off you make sure you get "your" carpet back. Goes around, comes around.0

If the landlord is seeking reimbursement for a new carpet, I believe he has to prove that the carpet was new when you moved in.
Did you leave your new carpet there or take it with you when you moved?0 -
            Absolutely gaz.
A landlord can't claim for a new carpet when the old one was part worn/mildew ridden/etc.
That would be betterment. He can of course claim part of the cost of a new one, ie the "worth" of the old one.
A lot is going to hinge on how the carpet is described in the inventory.0 -
I left the carpet there, discarded the old one he had. Remember that he said this was fine."The only man who makes money from a gold rush is the one selling the shovels..."0

Sadly you have no proof he said that. How is the old carpet described in the inventory ?0 -
It just says "no underlay, laid to concrete" doesn;t mention quality etc"The only man who makes money from a gold rush is the one selling the shovels..."0

In that case wouldnt he have a problem proving it was a different carpet? So basically he can go swivel?

No, it's a slightly different colour, I guess we'll see... (No other carpets downstairs for it to look "odd" etc)"The only man who makes money from a gold rush is the one selling the shovels..."0
