    Just a though could i claim income support as my wife gets carers allowance for me?

    New claims for IS on grounds of disability are treated as claims for ESA.

    Just got the letter telling me i have failed and got the report and oh my god how wrong it is.
    You're not the first..
    First of all she has put in there that my wife is my girlfriend and all my meds are wrong and also we put in the form that we got that i have fits 3 or 4 times a week but she has given me the 6 points for having a fit at least once a month but no more than once a week well wait a min we put in form i have them at least 3 or 4 times a week and we told her that at medical.
    It all adds up to show incompetence, but as said, stick to what's important.
    Did you get it recorded? Keep a copy of the completed form? Can you get evidence to support what you said?

    she has put on that about the fits that the evidence would therefore suggest significant functional restriction is likely but what does that mean?

    she is also put in there that wetting myself is consistent with a seizure but given me no points for that.

    Can i send a letter to them to appeal now without the Sick note from GP as cant get in to see her till next week and then when i get one to send it to DWP or will they want it together?
    You can, the important thing is the deadline of 1 month, + 2 weeks after asking for SOR. Send everything recorded if you can, as with the deadlines, it's more important than ever.
    also how will this affect housing benefit and CTB? It's a good idea to phone & check, they may have ended your claim. A phone call should sort it out.
    also im on DLA so do i need to tell them?
    No, your DLA is separate, though it can't hurt, just in case. You may want to get paperwork from DLA to support your appeal though.
    It would help to go to CAB aswell.

    I have heard that incontinence associated with seizures is disregarded as a 'normal' part of the siezure. However, this is not written in law, so it can be challenged.

    Nevertheless, it might be better to focus on the frequency of the seizures as these are occuring more than once a week.

    Does that mean, that as i have UTIs and RIs almost continuously and i totally empty my bladder about 2-3 times a week, it would impact a claim for ESA? Im sat here scared to apply!!!!!

  • rich as someone who also has epilepsy(altough i dont get incontinent with it)and whose IB to esa is due very soon i think its bloody disgusting that you werent awarded 15 points,what if any medical evidence did you supply?
    as others have said get help if possible with the appeal,if CAB are too busy try DIAL if you have one in your areas

    They had a report from my GP and also had a diary that my wife keeps with all the times and dates of my fits but she didnt even look at it.

    did you supply a copy of your prescription?

    I took my meds in with me but she even got the dose wrong on the letter i got today.

    she put i on;y have the meds 1 times a day but i have them 2 times a day and thats what its says on the meds as well.

    Couldn't his wife claim IS though as the main claimant on the grounds of being a carer and have Rich on her claim?

    That's what CAB advised my DH and I to do if I fail an ESA medical and don't have the health to appeal.

    rogerblack is wrong rich, you could still get IS so long as the carer claimed it ie. your wife, he is correct in that you couldnt claim IS on the grounds of disability though.
