Consumer rights?

Hi, got a new Samsung Galaxy on a 24mth contract in Feb 2012 with Vodafone. Phone has since developed faults, no internet connection, texts come through hours late, calls from my partner (whilst standing next to me) go straight to answerphone, that sort of thing. Spoke to Vodafone about 6 weeks ago who have fobbed me off with the usual stuff...take the battery out, networks being updated for a month because of the olympics, testing the line via phone, eh? All to no avail. I've now lost patience with the phone and want it replaced!!
They say they wont replace it they will only send it off to be repaired. I'm insisting under the sale of goods act they have to replace it? They say no.
Where do I stand?

Its their choice if they repair it, after all they only have your say so.
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

Assuming that the goods were supplied in conjunction with a service, your rights are under Section 11N of the Supply of Goods and Services Act 1982.

    Hi Robthemusher,

If the handset has a fault or is not working correctly, it will be covered for a repair under your warranty. We would only issue a replacement if the phone was unrepairable.

If you would like to arrange the repair, you can get in touch with me via the address here with WRT135 FAO Heidi in the subject.

    Kind regards,

    Heidi
