been a month and still no prom dress

    Just out of curiosity, is it totally legal for a company based overseas and with no physical presence in the UK to operate from a .co.uk website?

    It probably is, but to me it smacks of deception a bit.

    It's totally legal, as the .co.uk suffix is not protected at all - you can use it as a business regardless of where you are based, or as a private individual (again regardless of where it's based*).

    There are only a handful of suffixes where the person/company is checked out, and they tend to be the newer ones.

    Ideally if you're using a site that you're at all unsure of you should run it through some basic checks such as:
    Does it list a proper contact address and UK phone number?
    What does a whois check on the domain say
    etc.



    *I have a .co.uk domain, and I'm not even a business ;)

    I buy lots from the Far East and currently I am looking at between 30-40 days for delivery. Where items are held by customs for the duty to be worked out then you can easily add another 2-3 weeks onto that.

    However, if there is any doubt about the legitimacy of a site then once the estimated delivery times have passed I would be looking to start the process of recovering my money.

  • Provided that it was a direct payment from your credit card and noth through a 3rd party such as Paypal, Western Union or Moneygram, then you should be fully covered under the credit consumer act if the dress doesn't arrive.

    Just found this thread, I too ordered a dress from promdresses online, it did turn up but was awful, nothing like the picture. They send to send it back £35 Fedex!! Now they have the dress back they say there is nothing wrong with it and won't refund, when they previously said they would!!
    Would the credit consumer act cover me in this instance? TIA

    What you should do is to contact your card issuer and tell them that you wish to make a claim under S75 of the consumer credit act.

    They will then send you a form for you to complete, and this will ask for all the details of the problem, what steps you've taken to resolve it, how much you are claiming, and more importantly, it will ask for copies of any correspondance between you and the retailer.

    Make sure that you send a copy of the e-mail you received from the retailer stating that they will refund upon return, and also a copy of the Fedex receipt showing that the dress was returned.

    Just to clarify, did you pay the money directly from your credit card without going via a payment processing or transfer service? (Paypal, Moneygram etc)

    Yes I paid directly by credit card, I've just filled in the template letter for section 75. I also have copies of all emails, should I send them with the letter or just send the letter initially.

    I feel really stupid when I look back at how we ordered the dress etc. you live and learn!

    The prom is tonight and she now has a gorgeous Jones and Jones dress and will look lovely, this refund bit is the only cloud for me but DD doesn't know!
