Buymobilephones.net T&C Section 14

Hi,

I've come accross a term which I've never come accross before with a mobile retailer. As quoted below:
14.1. Our offers with monthly contract phones and packages are totally dependant on the tariff selected therefore:-

14.1.3. You must not downgrade your tariff at any point during your minimum term. In the event that you do, we will invoice you the minimum sum of 100 GBP plus VAT per handset. The charge will be dependant on the tariff selected at the time of the downgrade.

The contract with the network provider entitles us to downgrade or remove certain 'bolt ons' such as an internet bolt on without charge, so is the seller allowed to charge us for doing so?

Has anyone purchased from the company in the past and removed a bolt on and been charged by the online retailer?

Would they even know if this is done?

I'm looking to get a contract and remove the o2 web bolt on so I'm curious as to whether I should or shouldn't go ahead with it, and if I do, how they will find out I've made these changes with o2.

I appreciate any responses.

    This is pretty normal. The dealer gets a commission based on the tariff you select and any bolt-ons you have with the deal, and this is assumed that you will stay on the same tariff etc for a minimum period. If you remove a bolt-on or downgrade, they get clawed back part of the commission, so they're passing that on to you. The commission they receive goes towards the handset they provide you with, any other accessories or gifts, cashback, then whatever's left is their profit. They are therefore perfectly within their rights to protect themselves.
