the answer is YES
speeding is a de-criminalised offence, in other words you broke the law but you do not get a criminal record
however you have failed to respond- different charge now

lol if this was aimed at me which im not sure, just receved the letter this morning so i still have the 28 days ..so i havnt responded as of yet..

so it doenst matter if u cldnt see the police van..cause i and i know im not alone when i say this thought anything I.E speed camera or the mobile unit had to be seen clearly not hidden behind a bush or bus stop etc etc.....and i also did not know that a camera could take a picture of you frontwards i thought u had to be moving away from the vehicle.
Am i allowed to see the pictures aswell and shld i ask for these before i respond to the NOTICE ..ty all0 -
Under the old, defunct hypothecation scheme, camera partnerships were allowed to keep some of the fines they collected to invest into "road safety." In practical terms, this meant enlarging themselves and putting yet more cameras up.
In return the SCPs had to paint cameras in visible colours and put up signs. Failing to do so, does not, nor has it ever impeded or prevented prosecution.
Hypothecation ended in 2008/9 and all fines now go to the Treasury. SCPs have recently expanded the thresholds for speed awareness courses as these have become a major income source for them against a backdrop of reducing Government and Council funding.
Vans typically contain laser detection equipment with video or DVD recording ability. Most use side-door or rear-opening window vans and can detect the speeds of vehicles approaching them, or receding away from them. A laser device gives a (-) reading if the vehicle is moving away from the device.
You are not entitled to evidence of your alleged offence until summonsed and a not-guilty plea entered. You may be successful with a request for "a photo to assist with the identity of the driver" although this isn't binding on the SCP and doesn't stop the 28 day clock ticking.
Those wanting to know more about how sped detection works, or wish to gain an understanding of how prosecution works should come over here and spend some time studying the cases which crop up;-

In 2007 I was allowed to view the video of my alleged speeding (and being caught by a laser gun) and still allowed to accept the fixed penalty offer. There was no issue of driver identification involved.
I don't know if it's changed since then.We need the earth for food, water, and shelter.

Although not entitled to see evidence of your alleged offence, an SCP may provide sight of a video or photo at its discretion.
Suggesting this may assist your identification of the driver is more likely to elicit a positive response than a "I want to see evidence" which is often met with refusal.I am a mortgage broker.
