Think TFS have breached my guarantor loan contract
Comments
-
actually i am neither the debtor or the debtors partner, but i am someone who has tried to tell the facts!
TFS loans is a scam loan company and I personally think both the debtor and the OP should have done their research.
but i do not see the point in the OP coming on a public forum to ask for help then not give out the true facts, how does the OP expect advice that works if everyone is concentrating on what they 'think' the debtor has done wrong, I was at the debtors house when he phoned the OP(several of us were there), which is why i am defending the debtor, because the OP has said that he cant get in touch with the debtor which is a lie through and through.
as i said in a previous post when is someone actually going to blame the loan company, which has 4 different names and lots of scam alerts?
This is not my views this is cold hard facts!0 -
It does not matter what the debtor says or does. He has breached the agreement. The company are within the law going to the guarantor. And no amount of wailing "it's not fair" will change that.
The OP has been stuffed. Your friend has stuffed them. Doesn't matter how you see it - if there is money still outstanding, a stuffing has taken place. There is no point championing whatever your view of justice is here, the law will out.
So are YOU going to repay it?Debt free 4th April 2007.

PS What do you care what random people on the internet think? If you have a point to the OP why not, I don't know, phone them?Debt free 4th April 2007.

as I said I am not the debtor, but it would seem like you don't like reading through the posts anyway.
let me write this slowly as it seems you cannot read very well
I am not saying that the debtor should not pay this back , he is trying to sort it all out
i am saying that the OP will not get good advice whilst he lies on his posts.
he has said he has tried to contact the debtor in every way he knows how
the debtor was the one who rang him just before the OP wrote this post to try and sort things out but the OP was complaining that he had a bad signal on the phone
at no point have i said that the debtor is in the right or should not pay it back!
which part of that is difficult to understand??0 -
i cant phone them because unlike the OP having the debtors phone number I do not have (or want) the OPS phone number0
-
well that is great! You and the OP are in agreement that the debtor should pay it all back!
You just seem to be bickering over some teenage he-said-she-said nonsense so as we are grown ups we can put that aside, it isn't really relevant to the fact that OP is out of pocket and in an unpleasant situation through trying to be a nice guy.
Now go and convince your friend to pay him the money now, and it'll all be over with!Debt free 4th April 2007.

And you are too gullible but we can't all be perfect huh!0 -
Two points of interest here. If the debtor can’t read or write very well then it is little foolish of them to sign for the T&Cs of this loan (unless they had a legal advisor with them explaining what they were getting themselves into). It is highly likely that the loan company have not done anything wrong in attempting to recover the outstanding debt with the guarantor (as I am guessing these would be covered by the T&Cs).
Secondly the guarantor should have never got involved in the first place. The loan company did not believe the debtor would be able to manage the loan (and they were right), so have ask for a guarantor as a condition of this loan being agreed. I think these sort of loans should be banned as if the loan company are not willing to lend directly to the borrower then the loan should be simply declined at the outset.0
