Pay Pal Reversal, iQor, help!!!1

Right, im sure this has been gone through a million times as alway use special delivery but unfort 4 moths later I find out I have been stung! please help....

I sold a phone one ebay. they guy paid via paypal. i transferred the cash to my bank account and then came to pick up the phone. 4 months later I get a charge back and im left with a 750 pound negative paypal account and no phone....

i have refused to paypal the balance as if the funds were fraudulent then they should never have been released into my account. I went down the police station and the police said that the email, name and car registration was well known with credit card fraud.

I now get phoned at least 3 times a day by the debt collectors from paypal. i never answer to them! Not sure what to do now as Im not paying them but neither do I want my credit history affected.

Any information on how to solve this would be great.....

    I don't think you can solve it, you fell for a very common scam due to not understanding how PayPal works.

    the debt collectors used by PayPal have been fined in the past for their tactics, so go onto the debt boards and find out exactly what rights they have, and more importantly what rights they don't have. You will be hassled so you will have to stay tough, but make sure you do check what they are not allowed to do so you can complain as soon as they overstep the mark.

    Remember also, don't be tempted to open any new PayPal account or use anyone else's as you will endanger them as well and if they do associate you with another account they may take funds from that one

    Incidentally as you knew you had to send the phone special to be covered, why did you allow the collection?

    I think the biggest problem is that you have to get to this stage to find out the hard way. People like you put it in plain English.

    If paypal is to be you pal then surely when starting an ebay auction it should alert you when ticking the local pickup box that paypal will not cover you and alert you to the dangers in this rather than having it all hidden in miles of terms and conditions that never gets read.

    anyway thats by the by now. The buyer asked if he could come and look at the phone to make sure it was a 4s and not a 4 as the 4s was new out and wanted to check its authenticity!

    I have the guys email, car reg and phone number, he's stolen the phone but according to paypal I'm in the wrong!!

    I am not English and I understand it, so it cannot be that difficult.

    And yes, Paypal won't cover you as you didn't abide by their very easy terms and conditions. Post it Special Delivery - hell you even said so yourself!

    Here is how you solve it, it is very easy, of course if you care about your business!

    You send Paypal their money, and you put it down to experience, and you have learnt to never do this again!

    You did not abide by the terms and conditions given by Paypal, of how to complete a secure transaction. So to be honest, your are yourself at fault for this loss! Special Delivery would have solved it all!

    If indeed you running a business, how much are you loosing compared to the one phone you have lost? And stop using Paypal?
    Sometimes we just have to take the pain, and get up again, and go on! At least there will not be a next time, I am sure it has been a valuable lesson for the future!
    Let it go, and give Paypal their money, and move forward, because it will not change!

    I found this information posted by a sandman1976 and it seemed helpful. The only thing is i want my credit history to be kept clean and I think this will affect it? How accurate is this information?

    "Just to let you guys know, i have had these people after me before, they have no real rights.
    For a start they are not debt collectors, debt collectors are used by courts and councils and do have legal power.

    These people are scare companys, their official name is "collection agencies", they are not allowed to call themselves debt collectors or baliffs, if they do they should be able to give you a registered number...which they cant.

    A collection agency can only ask you for the debt owed (if there is a debt).
    They CANNOT take your property, Enter your home or demand payment by threat.

    Try not to answer the phone, if you do answer the phone give no details, all these people have done is bought the supposed debt, then they add a few quid and try and bully you into paying with scare tactics.

    If they dont succeed in getting the money they will then sell it onto another "collection agency".
    They will then attempt to harrass the money out of you.
    An so on and so forth until it eventually flags up as a lost cause and written off.

    If you accidentally answer the phone to them do not confirm your name.
    Just hang up and if possible block the number.
    the less contact they can get out of you the faster they give up and move on.
    If they get a rise out of your they will push harder.
    If you sound like your panicking they will push harder.

    IF you had a debt with paypal or ebay, i wouldnt worry too much.
    There are no confirmed cases of ebay/paypal actually going to court with someone.
    It would be too much like bad publicity for them, the last place people want to sell and shop is a company known for jumping on their clients!

    Summary:

    Dont answer & block the numbers they call from.

    NEVER give your details EVER on the phone - It could be anyone calling.

    They ARE NOT legally authorised debt collectors or baliffs.

    They WILL threaten you with court by mail - Ignore this - trust me they will make FINAL demands time and time and time and time again.. DO NOT respond to these letters. they will come to nothing as the courts do not like these rogue companies at the best of times.

    I have 6 years worth of "final demand before court action" letters.
    They are fun to look back through, and make good fire lighters too :)

  • i am also going through this dispute, i allegedly owed £453 to ebay and iqor have managed to turn this into £700 odd. they did this because paypal.com converted the £453 into US dollars and now Iqor have some how mis read this an think i owe £700! if a company can make such a simple error i really dont have much faith in their legitimacy!

    also, is the above advice reliable?

    This is where the laws in this country become a joke.

    I have the name, address, phone number and car registration of the guy who is knowingly involved by the police for credit card fraud and I have evidence of him breaking the law for the police. However in order for the police to do anything then either paypal or the guy who's credit card has been used fraudulently must make the complaint!

    The police also told me that the debt collection companies have access to the car database file. Im not going to knock on the boys door but if the debt collection company want to follow up their stolen fund they can acceding to the police.

    Anyway I hope we can work on this together rich as I know for 1 I won't pay them a single penny and I expect my credit report to remain clean as I have done nothing wrong!

    iqor have just tried calling me on a different number. 01789 404782 they used to try on 0161 870 3623. They were also trying me at 6am from 0844 879 1720 so you know what numbers to avoid answering!

    Your thread title says that paypal are taking you to court, although this has not gone that far yet, and is doubtful if it would.

    PP have extremely poor cust service. I used to be an active ebayer, but packed it in when an item i sent to a buyer was reported as not received. In spite of producing a certificate of postage, they started to pursue me. First this was through the guttersnipes at Robinson Way

    I write in response to your letters dated xx and xx. I will make it clear here that this alleged debt is wholly disputed. Your statement "Any queries in relation to the debt have been resolved" is audacious, and completely untrue. I have no intention of making any payments until this dispute with PP is correctly addressed and conducted professionally. I also require, upon receipt of this letter, an immediate cessation to your deliberate use of nuisance telephone calls in relation to this dispute. You imply that court action may be taken. Let me make it absolutely clear that i will use all resources at my disposal to defend myself against and vexatious or frivolous action thet you may institute. I take with a pinch of salt, your liberal deployment of magniloquent diction.

    Horwich Farrelly solicitors responded and said they had returned the account to the creditor (PP)

    It then went to Intrum Justitia, whom i wrote to with much the same letter as above, but then added that "There is a clear argument that the reason for the alleged 'debt' is due to an incident of criminal activity", and that "i do not intend to come into association with, or indeed fund the activities of criminals".

    And that's the last i have heard.

    I think you are a very very long way off from any court date. PP in my opinion are packed to the gills with this sort of dreck, and probably cannot move for threats of court. There are many many more people who capitulate and give them their required returns for their endeavours. As long as the majority of the people they pursue give in, then they will stomach the samller percentage who fight back. Its just business. They will give up, because there are easier things to do

    I would not pay too much attention to a person who does not have any grasp at all of customer service or UK law. Sellers are always responsible for getting items to a buyer , it is arrogant to think that buyers should Lose out ust because a seller can prove they posted something.

    As a buyer would you find it acceptable that a seller tell you that thee is no refund when you item didn't turn up because they can prove they posted it, I wouldn't. The poster is therefore unreliable.

    These debts have a habit do going dormant for a year or two but then starting up all over again and Some people are daft enought to try trading under a different name or address and are surprised when PayPal take the money back then.

  • hi, im new to this forum. just wanted to ask some advice.
    had an account on Paypal, but i closed that account. after a few days paypal email me saying i have a dispute on my account and need to resolve. they say someone sent me money in my account and i owe paypal £750.00, they keep calling me, and harrasing me to pay this negative balance. which i dont really know because that account was closed. Now i recieved a letter from IQOR debt recovery services, heres the letter!
    PAYPAL PREMIER HAVE PASSED YOUR DEBT TO IQOR RECOVERY LTD WITH INSTRUCTIONS TO RECOVER YOUR OUTSTANDING BALANCE OF £750.00 IN FULL. ACCEPTED METHODS OF PAYMENT ARE DETAILED............... IF YOU DO NOT TAKE ACTION TO RESOLVE THIS MATTER EMMEDIATELY, WE MAY COMMENCE LEGAL ACTION IN THE COUNTY COURT/SHERIFF COURT. THIS MAY WELL RESULT IN A JUDGEMENT / DECREE BEING RECORDED AGAINST YOU.

    I came across to another thread to about sending them a letter Template N. to ask them the details about this debt, and pay £1 postage. i did that today and send that letter.. wanted to know if this works? thank you. hopefully to hear from u soon, as im so panickin about it.
