Salary paid late, Company say its on time now compared to being early before

For the last 10 years I always been paid on the 23rd of the month. All my bills are paid on the 24th and the money must be in the account by end of bankign on the 23rd. Worked fine for the last 10 years.

This month I wasn't paid on the 23rd, and after inquiring they said they are learning a new system and some payments may have 'bounced'. I was eventually paid on the 25th and now have Unauthorised overdraft charges, bounced payments and Unpaid item charges totalling £65 ! (plus I'll apparently be billed seperately by the various payees for unsuccessful direct debits).

I asked the company to pay these charges as it wasn't my fault. They refused, saying that have until the 25th to ensure the payment hits my account and its upto me to ensure I have sufficient funds in the account to pay any bills upto and including that date. They also said that future payments could also be paid anytime between the 23rd and 25th of the month.

What can I do? I can't afford these charges!

    What does it say in your T&Cs of employment? An ex employer of mine had an 'official', documented, date of the 26th...yet for over 25 years they always paid on the 19th for some reason.

    Personally, I think one day isn't a good enough timescale between wages and outgoing payments...that's why I have all my outgoing payments set to 7 days after 'official' payday.

    You could call your bank and, if it's your 'first offence' they may take pity on you and waive some/all of the charges.

    Then, call the companies and move your DDs etc to a few days later from now on.
    Are the words 'I have a cunning plan' marching with ill-deserved confidence in the direction of this conversation? :cool:

    Good advice. I really ought do the same for my council tax and water DDs! :o

    As a last resort, you could always take your employer to the county (small claims) court. It's easy. See https://www.moneyclaim.gov.uk/web/

    Check your contract for payment terms and if they have paid late persue a claim for costs..

    for reference it is not sensible to have payments going out based on pay day without a backup plan there isalways the risk it will be late or not turn up if they go bust.

    Either a buffer in the account OR access to saving to cover any delays based on pay being late OR overdraft facilities to make sure no payments are declined.

    It is also IMO not a good idea to sue your employer IF you want to keep your job!

    You were asking for this to happen and must accept some, if not all of the blame. No system is perfect so common sense (which appeaared to be lacking here) must come in to play.

    I suppose when you've had something happen 120 times without a problem common sense tells you that it works for you.

    This is where an authorised overdraft (that you wouldn't usually touch) is worth its weight in gold.
  • My company pays on the 24th but the date in our contract is 26th. We do this so if there is a banking problem we have time to rectify it. Depends on the date in your contract as to if you can claim 100% unlawful deduction I.e withholding pay.
  • Personally I think your employer has a degree of responsibility here.

    I have worked in the same company for 13 years, my payday has always been the 20th of the month BUT we always use to have the money in our accounts by the 18th of the month. In the terms and conditions it clearly stated the 20th was the payment day, however it was normal practice that cleared funds were available on the 18th eg. if the 18th was a Sunday then I would be paid on Friday 16th.

    Around 6 years ago we were merged with another company and we were notified that although no change was being made to our contracts but our payday of the 20th would now be enforced. So now cleared funds are available by the 20th and not the 18th.

    I remember we were given at least 6 months notice of this change, to give everyone chance to change DDs etc.

    I am not saying this is the same with your employer but it sounds like a similar set up to me.

    The same thing happend to us, and I was amazed how many people complained that they didn't get paid on the day and their bills didn't get paid. I always make sure I have a small amount of cash in reserve in case such a thing happens. But its only happend once in 13 years!
