    under the new tenant deposit scheme, if a deposit is not protected, a landlord cannot give the tenant notice to quit, and then has to give the tenant 3 times the deposit .................this is some deterrent in my view

    The agent we rented through went bust ages ago, he was self employed and used to run a mortgage business from his shared ownership flat (THE CHEEK OF IT!!!! How many people desperately need these places because they can't afford anything else???) but it wasn't registered. See... I found out a lot, but unfortunatley not enough. I think it's time for the IR to have a go.

    Just interested as I've never had to do it before so would like to add it to my repertoire of 'useful stuff to know'

    Are the government going to advertise the new rules regarding the new tenancy deposit scheme?

    I would put my mortgage on my belief that next to no tenants out there even know about it.
    Even if they do know about it, housing is so sought after that a lot would 'forget' about it in return for a property that is half decent.

    There will be a loophole that will soon be found, and the situation for tenants that are exploited will remain.

    I'm not cynical I'm realistic :p

    Found it out before I started doing MSE. Used Google on his address, rang companies house, used electoral register - and once rang his mobile (now on answerphone only) pretending to have found something expensive belonging to him. That's how I found his HA address.

    Confusion, confusion.
    The landlord can give a notice to quit, they just can not use the S21 route.

    It goes to show that this scheme is not understood, I bet most tenants(and landlords) still do not know how an S21 works.

    This scheme starts in less than a month, a few pieces on the news and newspapers will not decipher this legislation.

    i was having the same problem with my landlord and i have recently found his correct address, i tried to serve him three times and i called the court adn asked if i could send it regular post to which they agreed, i got a box put the papers in and put a bow around it and birthday wrapping paper. registered it and sent it.

    i bet he will sign for it.

    So, you've just rented your flat and found out your deposit isn't protected. You ask your LL to register it...he refuses. You go to court and "take some action" He refuses to comply and does what above LL has done keeping your deposit..... I disagree that the new schemes will regulate such behaviour...but hope one day I am proved wrong,

    I would not normally withhold the last months rent but if I've done as you say then I'd just get my deposit back by not paying the last months rent. Without the deposit scheme I would not know of or have a documented reason to do this. The lack of co-operation with the deposit scheme is an early warning to stop paying the last months rent.
    There will always be a core of rogue LL who take cash deposits, do not register them and then refuse to give them back. Unfortunately it will continue to be unwitting tenants who cop the fallout from this. If you read tens of posts a day on this very forum, tenants often post VERY basic questions about their rights when dealing with LL's....without a huge public information campaign how is the renting Joe public supposed to know the ins and outs of this new legislation when many honest landlords don't even have a clue?!

    As for how the tenant knows, well somehow I think word is getting round and will continue to do so. But I agree many tenants and landlords know surprisingly little about legislation and their rights and responsibilities so not everyone will know for quite some time. Still some tenants knowing is better than we have now. Presumably the scheme will need some kind of advertising to let all landlords know as the penalties for non-compliance are high.
