Landlord cancelled my deposit cheque :(

Hi there,

I finally moved ouit of the hell hole i was living in and i sold some of my furniture to my ex landlord. i left quite a lot there and he wrote me a cheque to include my deposit and the money for the furniture. three days later he cancelled the cheque and sent me an email saying that he didnt appreciate me complaining to the council. He is now refusing to answer my calls, my emails etc and is refusing to give me back my money.

i filed a claim with mcol and it turns out that the !!!!!! has moved, i asked him for his new address and he said that he no longer needs to supply me with his address. so i have a court case against him and nowhere to send it to. i did a register search and he was never registered at any address, dead dodgy if you ask me!!!

Anyone ever had to deal with anything like this? essentially he still has my furniture and my deposit.

help please because i dont want him to get away with this at all.

    She has been going through the court thing and speaks about what your dilemma is. Its a long read but well worth it ...should be helpful for you...

    Sorry to hear about your problems with the landlord.

    If you look at Eagerlearner's massive thread called "help re flat deposit" or similar there's loads of good advice there about how to find your landlord.

    Regarding the cancelled cheque I think you should get some advice from a law centre or your local council as I believe in this circumstance it could be regarded as a type of fraud as it should have been honoured and was not fraudulent in any way. I'm unsure if the police do advice, but you could ring them too?

    thanks, i am going to call the police because in essence not only has he stolen money off me but he has my furniture that he never paid for as well. i just did a registry search and i think i may have found him but i am not quite sure. ho hum lets see what the police have to say eh?

    Sadly bad cheques or cancelled cheques are not considered criminal actions in this country, we're one of the few countries that treats this as a civil matter.

    The sooner we learn from America and Europe and make people accountable for their cheques the better off we'll all be.

    Can't you go to your old flat/house and ask the tenant what the landlord's address is?

    Typical, this is so infuriating and frustrating because i feel he is going to get away with it and its so unfair that the law cant be on my side. i wonder is there anything that i can do as regards the furniture though even if the police wont deal with a cancelled cheque?

    It may fall under obtaining goods by deception, a phone call to the local Police station might enlighten you, but I wouldn't hold out much hope.

    I thought the Major govt changed the law on this. Not sure though. Possibly worth a call to your friendly Bangalore bank call centre to check.

    called the police yesterday and they said that it was a civil matter and that there was nothing i could do ho hum!!!
