    1. They do actually review it (you will get a favourable response).
    2. They do nothing but pretend they have reviewed it (you will get a 'sorry, but you're going to have to pay it' response.

    I’ve been speaking with the leasing company reference the below who have agreed to pull out private car parking charges and send to my department for action.

    We will then forward to the driver who can either pay, or dispute as is your case. However, I have also had in indemnify against drivers losing appeals as bailiffs would seek to enforce direct against the lease company. As such, failed disputes would be passed on to the driver in full.

    In short I won’t pay and re-charge providing you the opportunity to dispute. Failed disputes will be passed on with any increased cost.

    I trust this settles the matter for you.

    Well done, the people upstairs have a bit of brain for once, though they are still dreaming as regards the bailiffs.

    But if it arrives- YOU don't fight! You go straight back to Lidl's and TELL them to sort it while you wait! This parking company is their agent and MUST follow their instructions.

    Not that it will come to anything as you were told at the outset, but hey these firms need to realise that THEY are responsible for the excesses of the cowboys they put in their car parks...

    Bailiffs? For a breach of contract without a court case?

    This person needs to actually get the facts before spouting off (they are confusing council tickets with invoices still), but still, a result for the time being.

    Oh dear. That is not a victory. Please don't let this go - you can't drive this car around knowing you have this situation hanging over you. :mad:

    Did you realise that because it's a scam, you will NOT win a 'dispute with a PPC' unless you get the retail Store Manager to cancel the fake ticket. If one letter arrives, there will be lots of letters. And you will almost certainly get a fake parking ticket re this 'overstay'.

    The person emailing you is completely wrong about bailiffs, this is NOT a parking fine. With a private matter, the only time bailiffs could get involved would be only against YOU if you got taken to Court by the PPC and lost, and then refused to pay. It's a civil allegation of breach of contract against you, and you alone.

    Where to start? I think I would honestly have to reply summat like:




    Dear xxx
    Thank you so much for trying to resolve this as I expect a letter about the allegation will arrive within the next few weeks.

    However, I am sorry to say the matter is not closed because, unfortunately, the information you have been given about bailiffs is not correct. A bailiff cannot at any stage enforce a 'fake PCN' (any private 'ticket') against a registered keeper or a car lease company - not even in Court.

    It is only a fake PCN = a fairly well-known scam attempt against a driver. Any private firm sending such a letter to 'lease company' is simply trying to get the driver's details or they hope to just get the money under false pretences. As per the BVRLA advice they really are best ignored like any speculative unsolicited letter/email. They cannot issue fines, there is no debt and unless they take me personally to Small Claims Court and win (highly unlikely and only a concern for me alone) they cannot 'enforce with bailiffs'.

    If a driver 'disputes' such a 'ticket' these companies have no appeals procedure as (to be frank) it is a con. If one letter arrives about this matter there will be more - usually on debt collector headed notepaper - but at no point whatsoever does it become the liability of the lease company or 'employer'.

    At no point can bailiffs enforce a private fake PCN against 'lease company' - I think there is some confusion here?

    This makes the situation very difficult for me and is the reason I wrote up front. So sorry to refer it back but I suspect that someone at the 'lease company' is muddling this with a real PCN (Police or Local Authority only). They look similar but a private one is a worthless impersonation.

    As I said I am very happy for lease company to pass on my details - or if they prefer, to pass me the first letter and I will respond naming myself as the driver so that they send their speculative letters to me instead. No further letters should then be sent to anyone except myself but if 'lease company' were to receive anything else then they should just ignore it, as per the BVRLA advice linked before.

    I cannot accept any possibility of being charged for this matter as it's not a parking fine, not in my contract t&cs and a decision as to paying/ignoring is solely for the person the parking company alleges has breached their 'contract'. In this case, their speculative target is me alone - and I take full responsibility.

    (P.S. in the meantime, how about a letter to the Store Manager referring to the incident and saying that if a 'ticket' arrives you trust they will get it cancelled. Simple as that, in order to get the ball rolling towards the only way you can stop these letters.).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
