refused ppi refund on ltsb c.card even though self employed and existing med probs ??

I am at a loss here, first refusal :mad: from ltsb on 3 c cards i had with them.
basically they are saying that it was not missold, i have rang them back to ask them to reconsider as i had existing medical problems which i wasn't asked about, was self employed and would not have been covered i have since found out..wait and see now i suppose or it could be off to the ombudsman ....

    unfortunately i warned about what lloyds bank were doing, at the same time mse & lloyds bussoming up saying how easy it is avoid cost of representation , simple diy lloyds rejecting claims like yours, scary

    its anyones guess if you have saved 30% so far or cost yourself 70%

    If they reject again then take this to FOS they are at least free.

    So you are saying had the op used a claims co Lloyds would have upheld the complaint?.

    He is indeed.

    He seems to think he is exempt from Client Specific Rule 12 on page eight of the Conduct of Authorised Persons Rules 2007 issued by his regulator, the Ministry of Justice which prohibits him from saying this (which it does because, of course, it is untrue).

    I keep putting links but he seems unable to operate them.

    Yes, take it to the FOS if they won't reconsider. More fool Lloyds if it's then upheld and you no longer owe any money on the cards. The additional time it will take at the FOS will result in Lloyds having to refund more money than they could have done as the 8% stat interest keeps rolling up until the date of settlement.

    you're talking nonsense again. whatever the allegations are, you can say what you want about the mis-sale. the banks and firms have to review ppi complaints exactly the same way under the PS10/12 rules. so it wouldnt make a blind bit of different whether you went through a cmc or not.

    think i will safely stick to doing it myself..for a 1st class stamp and a phone call :-)
    on a serious note though if i was s employed and had existing illnesess surely i am right in thinking i was not covered anyway??

    With regard to the illnesses it would probably depend on what they were. With regards to self-employment, many of the PPI policies said they covered the self-employed but the conditions/exclusions which applied to self-employment in the actual policies made it very difficult or impossible for many self-employed people to actually claim. It's generally a very strong reason for complaint - the majority of the complaints I've put in have been self-employment based and all of them have been upheld, although a couple of them had to go to the FOS to get there.
