Am I being unreasonable?

Hi all
Would appreciate feedback if I am being unreasonable in leaving negative feedback here. Never done it before, dont want to do it lightly, need to bounce opinions.
I saw a game I wanted to buy for a relations birthday as BIN (it was a Wii game, described as excellent condition)
The birthday was for a Friday, so I emailed the seller and asked if I did a BIN, he would post in time for Friday. Seller responded with "yes".
Went on to auction (on the Monday) and did BIN and paid right there and then.
Also emailed seller and told him I had paid and please dispatch for Friday delivery.
On Weds, I got an email to say the seller had refunded my paypal, no other comms.
I emailed seller on Weds and asked what was happening.
Got a reply on weds night saying upon opening the game, discovered the disk was cracked and apologised.
Then on Thurs night got an email saying he had bought another copy of the game and would send it if I paid again (as he had refunded me) but would not get it for Friday, but he would pay extra for it to be "next day" on sat.
Thats no good to me as seeing the child on Friday. In the end I got the child a voucher.

I don't see that the seller has done anything wrong at all, apart from check the game before listing. As it was BIN, I doubt this is a case of lying because the item didn't make enough money. The seller has gone out of their way to try and help you. Big fat positive.One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0

Sounds like he went above and beyond to sort out a problem, even offering to upgrade postage at no extra cost when he didn't really need to.
The other option is to ask him to post it direct to the child if they can tolerate having to wait an extra day?<--- Nothing to see here - move along --->0 -
I think a negative would be a little unfair as he did refund you immediately after discovering his mistake. (although not sure why he didn't message you straight away).Seems strange he didn't check the disk before putting it on ebay, but at least he didn't mess you about with excuses afterwards but instead gave you a prompt refund and tried to find you a replacement.
I would probably not leave feedback at all - as you have been disappointed you can't call the experience a 'positive' one but at the same time seller did their best to rectify afterwards and so I don't think they deserve negative feedback (maybe a neutral for not checking the disk to start with if you really want to leave some, but like I said I would just not bother leaving any)0 -
You got your money back didn't you? Better that than sending it if it was broken - and you never know what exactly happened. No messing, no fussing, money refunded with 'next best scenario' offer of Saturday delivery.If you haven't got it - please don't flaunt it. TIA.0

Thats my problem here. He didn't NOT describe the item, he actually described as "excellent condition". And I guess thats my gripe I guess.
Did I check of seller feedback (after the event - isnt hindsight wonderful) and see two negs with similiar stories.
However based on this, I won't leave neg. (Your not all sellers are you??!?! ;-))

I am not a seller. I would leave neutral feedback if you felt strongly enough, he did refund you right away so you had your money back. Though it is a pain! I mean for all we know he has a kid who broke it since he first listed it? x0

If he has negs for doing this I would be worried to buy from him in the first place. He either makes a habit of making mistakes and doesn't check the items properly, or hasn't sorted them out properly. However, you bought from him without checking this, and he has worked things out properly.
It's up to you. I don't think I would leave any feedback. He refunded promptly, he did make an effort to try and sort it out, but ultimately if you are disappointed with him you do not have to leave any feedback at all.
Or leave a weak positive. Something like 'Transaction refunded - damage to game disc but seller apologetic and friendly' - or whatever fits. yes very unreasonable, as these things can happen!
Having 2 similar feedbacks tells you very little, because seller might have 10000 feedbacks or 100 feedback, 2 negative feedback for a seller of 10000 feedbacks, does not make him a bad seller, because there will always be a customer that is impossible to please!0 -

It may have been perfect when listed, until his girlfriend/child/mother-in-law trod on it.
