Hi,

I thought I'd just let people know how I got on after receiving a parking ticket last September from Total Parking Solutions.

I was initially going to pay the "fine" but some helpful person had put a note under the sticky "fine" holder saying not to pay and to look on line to see why.

I had a look on this and other forums and decided not to pay for reasons stated in many other threads.

I had the series of letter from TPS, then Roxborough, then Michael Sobell - ALL IGNORED

Then a few phone calls from them on both my home & mobile phones ( I knew the phone number they called from ) - ALL IGNORED

No further communication since January.......

Thanks to all who helped me to keep my resolve, and maybe it will help other too :-)

    Thank you. If only more people would do as you do, and come back and report success. We keep telling people that the Roxburghe/Graham White scam is all hot air, now you are confirming that.

    How did they get your home and mobile numbers?

    I got a sticker 11 months ago .... while there was one 4-5 month gap when I thought they'd forgotten me... I did suddenly receive another letter out of the blue. Ignored that one too, of course.

    The debt collectors find them from lists that are in the public domain, or even just with a bit of online searching.

    The DVLA 'only' release a name and address. :mad:

    I have been reading threads with interest about ignoring PCN's Parking Charge Notices, as oppose to "Penalty" Charge Notices.
    If I have it right, the ability to ignore and get away with it seems to revolve around having a contract with either the landowner or the Parking Company.
    The reason I ask is that my Wife works at a NHS Hospital who have employed Total Parking Solutions Ltd to manage their car parks. She has also had to now pay a monthly amount to park and has been given a sticker to put in her car.
    There is a NHS letter accompanying the sticker which clearly states:
    " Failure to comply with these Terms and Conditions and the car parking policies means that you are contractually agreeing to pay a £60.00 parking charge within 28 days.. The "Parking Charge Notice" will be reduced to £30.00 if payment is received within 14 days"
    It goes on to say that the fine will increase to £100.00 if not paid within 28 days and that they reserve the right to pass collection to a debt recovery agency.
    So, my question is, if my Wife happens to get a Parking Charge Notice,( for parking illegally, eg on the Hospital roads yellow lines) can she ignore it or does the fact that she is paying per month mean she has a contract???
    Any advice welcome.

    She won't be parking "illegally" as yellow lines do have any legal standing on private property.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    Firstly, of course, Paul, it's better to avoid confrontation by parking in accordance with the rules if at all possible. However, I appreciate that at busy times there may be problems, or the drones charged with enforcement will ticket non-existent infringements to justify their wages.

    Whilst it looks like a contract, there is clear law that says that the amount payable for a breach of a contract must not exceed the loss which was caused to the other party. Hence, plucking random and high figures out of thin air, does not satisfy that law and should be unenforceable because it is a penalty, which is not permitted in a contract.

    It would be better to start a new thread for this query, rather than continue the one about the ignoring success of the OP.

    I can't personally comment about the contract that your wife has undoubtedly entered into to park - except to say that it has to be "fair" - no use having 100 users working normal hours and only 10 spaces (but where is the reasonable cut-off point). The complicating thing is that people are less happy to "take on" their own employer's system - even if fronted by goons.
    However, in a very "nice' way can I take you to task over the "getting away with it" part of your post: when my car was parked by the person driving it for a little more than the "free" time, while the driver spent money in the shops on that site, and then I as the RK got a request to pay £60 (then £80, then £120, then threats of court (you know the rest), that was not a reasonable charge to make, there was no contract, the contract they think they have is unenforceable and their 'fine" is a fiction because one private person cannot "fine" another.
    So, yes, I did not pay, and after the threats - nothing. But I did not get away with anything, there was nothing to get away with in the first place.
