Hello James,
Thanks for the prompt reply, I maybe should have started a new thread but I am a new user and this one seemed sort of applicable.
In regard to the "get away with it" phrase it is just a figure of speech as it were, nothing derogatory meant in it I can assure you.
In regard to the fairness, that is definitely a sticky one, there are nowhere near enough staff parking spaces which is why dozens and dozens of them have to park on the yellow lines!!!!
Does my Wife's contract give them the right to charge, using a "Parking Charge Notice" I suppose is the main question.
Regards Paul0 -
Paul, maybe you missed my reply, a contract which provides for a penalty (a fine in everyday language!) is not legal and not enforceable.0

Unfortunately, I wouldn't be so sanguine as to suggest it's on its knees! So far as I know Simon hasn't had to downsize his yacht. But inroads are being made, and will continue to be if every poster or even reader on here passes it on to all their friends.0

I think if it said 'by signing this contract you are agreeing to pay a parking charge of £xx in the event that you are driving a vehicle which you park in xxxx reserved bays or allow a car to remain parked in the car park for a period exceeding xx hours'.
That sort of thing could constitute a contract I think (but I have no legal qualifications, just an interest and a background of reading a lot on parking forums!).
But they fall down with their sentence that starts 'failure to comply' = not a contract, a penalty for breach. Therefore unenforceable (don't tell them this now of course - but don't pay if ever she does fail to comply and gets a fake PCN!).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
