O2 - Sony Xperia S Problems

Hi,

I took out a new contract with o2 for the Xperia S, I have been enjoying the phone however it has developed a yellow tint to the screen. This has been well documented by various sources via Sony itself.

So I took my phone into o2 and said because I was outside of the 28 days return and the fact I bought the phone online, that they cannot change the phone and it will have to be sent off for repair.

This would mean I would be losing out on the phone that I had paid for and will contine to pay for during this time?

Do I have any leg to stand on in exchanging the phone instore, or will I have to suffer the loss and hand it in to be replaced losing weeks of purchases time?

    Unfortunately, the latter. In fact they have no obligations to replace the handset. They have a choice between replacing it and repairing it within "reasonable time" and without causing your "significant inconvenience". If you think that the inconvenience they cause is "significant", you can sue them.
    Re "the purchased time" you can use it with any other handset. Otherwise you can try quoting Supply of The Goods and Services Act and claiming a refund for the time they spend on repairing the handset.

    Also as the handset is a new model, chances are if they replace it, it will be with a brand new one anyway.
