You need to check this bit carefully, it sounds like you might have paid the £250 to an agent as opposed to the clinic /surgeon, if so the whole Section 75 chain might fall apart.
I paid the deposit to website who forwarded it to the Surgeon. I have the email from there representative saying they had been informed i had paid the deposit they requested me to pay to hold my surgery date and it was deducted from the final payment i paid in cash and the total amount that i was quoted that is documented in emails.

If the website isn't part of the surgery group, then you've got an issue.... They fulfilled their part of the contract, to book an appointment, anything after that wouldn't be covered by a Section 75 claim related to the £250 payment.0 -
I am not entirely up to date on the PIP implant scare so can someone update me please?
Have you been told that the implant needs removing? Is this now accepted procedure? or is it literally just a "scare"?
I am not being judgemental at all and I totally sympathise with your situation but what I am thinking is that if officially there is nothing wrong and this is just a desire/preference arising from the scare rather than a definite medical recommendation, then I don't think you will be able to make a claim off anyone. I'm really sorry about that but that's the way I'd see it legally.
Can someone confirm the situation?
Do they officially "need" to be removed? or is it largely a matter of concern?.
I am not belittling that concern at all, I'd be very concerned myself, but legally a worry over potential future problems may have no legal standing.
The info you require can be seen on bbciplayer watchdog 19/4/12 where Ann Robinson and Martin Lewis discuss the implants and section 75 its approx 10 mins in to the programme.
Basically PIP used Industrial cohesive Gel ( a cheaper option and illegal PIP owner is in jail in France now) the industrial gel is used in matresses and never fit for the human body In many cases they have been know to rupture and this industial gel gets in to the human body which is not a good thing. NHS here will remove but wont replace any private ones. In France there is over 30,000 they will replace there under french goverment.

My own experience of having done a few small claims is that it's extremely complicated. Why not claim for everything (except your friend) and see what they throw out. Just because you don't get it perfect should not prejudice your claim.

The debtor/creditor/supplier relationship, or lack of it, may prevent a Section 75 claim from being successful. The only people who can advise are the card issuers really. The OP needs to submit a claim and wait for a response.
I'm a bit confused though, the poster says that the implants were for medical reasons but then later says that they were because she had lost weight/tissue ? Did the loss of weight cause the medical problems ? I wonder if the CC issuers would take into account whether the replacement implants are medically necessary ? I only ask because there was recently another thread about PIP implants where the posters partner had paid for them, and there was a bit of a debate about whether her claim would work too because of the debtor/creditor/supplier relationship. The debtor/creditor/supplier relationship, or lack of it, may prevent a Section 75 claim from being successful. The only people who can advise are the card issuers really. The OP needs to submit a claim and wait for a response.

As I understand it the site used was not acting as a third party all dealings with them were a direct means to the surgeon that carried out the procedure so my deposit was paid to the site holder who then submitted it to the surgeon on my behalf. The site took no financial obligations with me. What if any financial obligations they have with the surgeon I do not know.
As for the questioning of my medical rather than cosmetic I didnt feel I had to justify myself but I will I had a rather large cyst removed from my breast line that also left me disadvantaged on one side....... by not cosmetical I mean i didnt just wake one morning and say oh I feel i want to increase my size by 2 or 3 more .... I was severley depressed and had been a while over my situation and i had my op to put me back to the size i was originally not increased.

Medical rather than cosmetic need is irrelevant.
You've got nothing to lose through making the claim, just you might fall into a trap re the agency issue0 -

If the company who debited you with the deposit trade separately from the surgeon/clinic where you paid the balance for your surgery, your CC issuer may reject your Section 75 claim. Get as much evidence of any connection between them as possible when you submit your claim.0 -

As i previously have stated I was requested to pay the deposit to secure surgery date. I have emails to prove this was paid to the site then received by the surgeon and knocked off the final bill for the surgery and I have all documented.
So clearly they acknowledged the site took payment and the surgeon received it. So my deposit was not for there services it was directly for the surgery.
A bit like using gocompare for some insurance ... u search the site find best deal and pay but the policy comes from the insurance company direct ( just an example of how it worked using the site to paythe deposit direct to the surgeon)
