Parking charge notice appeal rejected

Hi everyone,

I borrowed my parents car for two weeks and parked in the private car park located outside the back of the block of flats I live in (based in Manchester). The car park is for residents only; I am a resident and allowed to park there. During this time I displayed a valid parking permit, obtained from the porter, on the dashboard of the vehicle.

At the end of the first week I parked at night and did not notice that the permit had slipped forwards to the bottom of the dashboard where it was out of view - although you could see the top of the permit sticking out. On this one day I received a PARKING CHARGE NOTICE informing me that I did not clearly display the permit, and that it was not placed IN ACCORDANCE WITH THE DISPLAYED TERMS AND CONDITIONS. Great, so the same single guy patrols these car parks every day and on this one occasion he caught me out....well done, how clever of you.

So I appealed, and pointed out that I was a resident, had a permit, and that the permit was at the bottom of the dashboard - I even pointed out on one of THEIR PHOTOGRAPHS that you could see the top of the permit where it had slid down to.

The appeal was rejected (in all honesty I dont thik they thought twice about it).

Man, I feel like such a fool. They have my address, and the details of my appeal.

Can i still ignore this?

    In other news, research has found that ursine creatures mainly defecate in sylvan environments.

    And there you have the answer, these people are not there for the benifit of the residents, they are there to make money and they don't care where it comes from, he would have known you had a permit to park but saw a loophole to extort money from you, should you be silly enough to pay up, some on here would argue that the parking permit wasn't worth the paper it's printed on anyway.

    The losses they have incurred as a result of you not displaying your permit is...... nowt.

    So that is precisely what they can pursue you for. Nowt.

    Ignore the stupid ticket. However, they may possibly write to your parents - whichever is the registered keeper (although , now you've appealed, hopefully not).

    You might need to be on alert that if they get a letter, you can successfully convince them that its unenforceable rubbish.

    I don't know about the parking permit so much, though I think ISF has got it right.

    What I can DEFINITELY tell you is that the parking Charge isn't worth the paper it is printed on.

    Excuse me, but you are a resident, you have the right to park! No two-bit company has any power at all to fine you for not complying with some made-up condition which, in any case, almost certainly not in your lease...

    OF COURSE THEY REJECTED YOUR APPEAL! They want your MONEY! If they allow your appeal, they won't get your money! What would YOU do if you were a parking scam company?

    The mistake you have made is to think that this is a legit operation and that the ticket is real and enforceable.

    It is FAKE and it is UNENFORCEABLE.

    All you have to do to wave these parasites goodbye is to completely ignore them from now on. It doesn't matter at all that you went through their phoney appeal process. At the end of the day they cannot do anything at all- though you will receive a number of assorted threatening letters, depending upon which company this was. Well, when I say you, the letters may go to the car owner. If that's Mum or Dad make sure they are prepared and tell them they can safely ignore it completely. However, perhaps the only positive thing that may result from your attempt to appeal is that they will write to you rather than your parents.....

    Look in the sticky thread second from top in the forum list to get a preview of what templated letters they will honour you with, and that will also tell you the point at which they give up and go away when they realise that, despite your false start, you weren't actually a mug.

    Relax, my friend. It is all a SCAM. It isn't reality.

    Tonight I will speak to the management of the building and let them know that the company that is supposed to be protecting the residents parking area does not give a !!!! about the residents themselves.

    Is there anything else I should do - to watch my back?

    Are you a leaseholder? Or is your landlord? Is the space you park in exclusively yours (or your landlord's)?

    I'd also mention that the management firm are also legally liable for the actions of their agents, ie. the PPC, and that they are well on the way to being able to be sued for harassment under Section 3 of The Protection from Harassment Act 1997.
    The acquisition of wealth is no longer the driving force in my life. :)

    Good. As Stephen says above, the management is fully responsible in law for all actions taken by its appointed agents. They fully have the authority to TELL (not ask!) the parking company to cancel the ticket. Make it plain that you know this and don't accept the "we can't do anything about it" stance they usually try to adopt. They are the dog and the parking company is the tail; who wags who??

    Well done, the parking company does not give a flying **** about the residents, it regards them as its main source of income!

    That is why we refer to them as parasites. They serve only their own interests.

    If other residents have had problems (and they will have as the parasites are only in there to make money) maybe you should get together and press for them to be kicked out.
