Csa

My ex partner does not work and is on benefits. He also has a child by someone else. She claims from csa and gets £5 per week. I have never bothered to claim anything from him as he has chosen to cut our daughter out of his life. If I did claim, would I also get £5 or would that get split between the two children? I can't find the answer to this anywhere!!! Thanks for any advice :)

  • The current rules are i think 15% for 1 child, 20% for 2 and 25% for three or more so i guess it depend how much he gets after they calculate essential living expenses. Id claim just to make him pay if hes that sort of bloke!

    I suppose, but then that would mean he has more of a say in her life if he is paying maintenance surely. if he has chosen to cut her out, it would be easier for him to come back if I am claiming from him? I really dont know what to do!
  • You would get £2.50 a week. It hardly seems worth the hassle.

    As he is on benefits the most Csa can take is £5 a week so if you put in a claim it's only £2.50 you would get per week and other parent £2.50 also

    your %s are correct but under the current system there is no calculation of living costs and, as he in on benefits then it is a straight £5 that would be split between all claimants so £2.50 each.
    If he works and both cases are through CSA then he would be assessed at 20% for 2 children and you would get half each

    Thanks for the info! One other quick question for a friend of mine to around this subject.

    If a man has one child not living with him that he has been paying csa for but is moving in with his partner and her child (from previous relationship) and they have a baby on the way, how does that effect csa? How many children will he have to pay for? Thanks

    I think he still has to take responsibility for his first child and his CSA is unchanged. have you tried asking your question on the 'child support' section of this forum? There are people on that who are real experts on CSA etc.

    I'm still waiting for my 14 weeks of £2.50 payments, and a call back from the CSA from 3 days ago, they could not organise a !!!! up in a brewery!

    Really? I didn't know that. It seems a pity that the first child should lose out because the father now has a 'new' family.
