ESA Decision

Why were you dreading the decision letter if you knew that you were so honest when you were filling out your form and sent all your medical records then?
You got the right outcome and you've been put in the support group so congratulations to you.
I would however say that if you'd been refused ESA you'd be asking WHY. The rest of ill people who are refused do or did the same thing you did. Some people are refused or put in WRAG even though they've sent all their medical reports. I don't think anyone tells lies on the forms.
Fortunately for you when you get your Atos medical you won't be that curious to know what lies have been written about you as for most of us it leaves us angry and more deppressed. I was happy that I got ESA in WRAG as I didn't know much about the desciptors and just heard about even terminally ill people being refused ESA total and I told the truth and submitted more reports on the day. I wish I had never asked for the Atos medical report.
The mere fact more appeals are won means that lies are really filled in forms. By who, you tell me.
I so wish you'd just told of your good result and leave out the rest as we all do it.
Duvarayi, Yes, I was very concerned about the evaluation using the new descriptors because of what I had read on here and on other sites. My family were more convinced about me 'passing' - maybe because they don't read sites like these.
I've read posts where people tell you to use your 'worst days' when you complete the ESA50 especially when you have flucuating conditons as I have. I didn't - I sent in detailed descriptions on how my condition affects me on a day to day basis, the medical reports and Hospital letters I have. The DWP accepted that information.
Do people lie? You bet your bottom dollar they do. Was I saying that everyone on here lies? NO I WASN'T!
I posted on here to show people that the system can work, so maybe there isnt much need to worry as much as I did. I've been declared fit for work previously. I appealed so, yes, I've been through that already and I would appeal again if I needed to. The other point I was trying to make was to ensure that the ESA50 is completed with as much detail as you can. Have people read it through again and again. Have family write down how they see your problems affecting you and be honest with yourself.
The new system stinks, mistakes are being made left, right and centre. I thought I would be put into the WRAG at best. I came to that conclusion purely on negative posts I have read.
I apologise if posting something positive has offended you. I would say you need to get that huge chip removed from your shoulder - it might benefit you in future.
However to everyone else, thank you for your comments. I must admit I hadn't thought about requesting the medical report seeing as I'm fortunate not to need to appeal but I will do.
Thanks again0 -
I never wrote that on the form, why would I? when it is easily provable that it wasn't the case. It was what the Dr had written during the interview and he failed to record all the other info given to him about my previous physio which was on the form and I gave him evidence for which he refused to copy. I do so apologise for not wording my previous post so that you could understand that clearly and not misconstrue it to be me lying to obtain benefits rather than what its was which was a co*k up by the person doing the medical.well today was a complete waste of make up :eek:0

I have filled in the forms honestly multiple times, and each time a pack of lies comes back from ATOS.
Each time, I win at appeal.
Even filling in the form in detail was used against me by the assessor, claiming I cant have problems if I can fill in the form for crying out loud.
Have you requested a copy of your medical report yet, if not I recommend again you do so, you may be suprised what it says...[greenhighlight]but it matters when the most senior politician in the land is happy to use language and examples that are simply not true.
[/greenhighlight][redtitle]
The impact of this is to stigmatise people on benefits,
and we should be deeply worried about that[/redtitle](house of lords debate, talking about Cameron)0 -
The Atos medical I had in December passed me fit for work. I have sleep apnoea and osteo arturitus in my hands, wrists and right knee and a bad back due to being obese. I am appealing as the things the nurse wrote wasn't quite the truth and lots of things she left out if it was to my benefit. If I wasn't there I would have thought they were discussing someone else. She wrote that I was a male and that I drove. Who is going to employ me ?0

Who is going to employ me ?
It's vital to understand that ESA is _NOT_ granted because no employer in the land would dream of employing you.
It's granted because you meet the various legal tests for ESA.
For example, someone who can do everything but put either hand in top jacket pocket is entitled to the support group, and not expected to work at all.
Someone else who can barely work a washing machine, mutters to themselves constantly, has some difficulty walking, and can't understand more than simple instructions is fully fit for work.
If you appeal based solely on trashing small details in the report 'the assessor said I opened the door' - when your ability to open doors is not in question - rather than the actual capabilities being tested - you risk the tribunal not investigating the capabilities properly.0
