The difference between a 130bhp model and a 160 bhp model would be noticeable, and the price you paid reflected the performance you expected, so you probably do have the right to reject the car outright and demand a refund, but it must be done very quickly, ideally in person followed up by a traceable written method (or two) such as fax plus a recorded delivery letter.

You need to consider exactly what you want from the situation the work from there.

If you have legal cover on your house insurance, they might help.

Check the insurance on the 160 model before you rush out and buy a proper 160.

It maybe a group or two higher.

  • Thanks guys.

Unfortunately i missread the engine code in the book. Its actually a A20DTJ engine, which in the book states its a 130ps engine (128 bhp).

This is still 30 ps off the description of what i was told so it really doesnt change anything. I spoke with the dealerships head office yesterday and she says that even experian is reporting that the car is listed as a 160 engine.

Seems like someone made a boo boo way back to when the car was first registered. I am trying to get the engine verified either by locating identifying marks on the car or having the VIN decoded.

    the mystery continues.

Regarding what i want from this kaffufle. I would be happy with some kind of financial renumeration, either in reduction of the monthly payments or some kind of cashback. With a wedding and honeymoon coming up, the cashback would be really helpful.

  • Doesn't cut it I'm afraid. The car was still miss-described; they were in a position to know exactly what engine was in the car. Additionally, the remedy for intentional and unintentional miss-description is the same, so no worrys there.

A quick search of auto-trader reveals the 130 to be FAR FAR less popular than the 160.
  • Definetely fight this.

OP, get the VIN no and try calling another Vauxhall dealership or Vauxhall Customer Services and get them to confirm exactly which model you have.

Just got off the phone with a vauxhall main dealer. They have confirmed from GM that the car is indeed a 130 engine car.

However experian is reporting the car as a 160, which means the car has been registered incorrectly.

Ringing the DVLA to see if the car is legal etc.

Edit: Everything is fine regarding legality, it means im actually paying more insurance than i should also. So basically i have to get a letter from GM to confirm the spec of the car and send it back to the DVLA with the log book.

So now that i have confirmed the engine is indeed incorrect, how do i go about beginning discussions on moneys and such that i want? should i try to get 2 valuations for the same cars except one with a 130 and one with a 160?

I guess it boils down to whether you actually want to keep the car or not. If you do then you can go for a compensation for the difference the car is worth or just take it back for a refund.
  • Just wanted to report in.

Had a look around on the net and at parkers and such and found the difference to be around 400 quid.

Spoke with the dealer and they made an offer of 200. Told them wasnt overly happy with that and then got a second offer of 250 so i took it.

Got the car i wanted and a bit of cash back too, very chuffed.

Thank you all for help and advice!
