Car miss sold? What can i do?
Hi Guys
Got a quick question to ask.
I purchased a car on finance a week ago last friday. The car was described on their site, and auto trader as:
Vauxhall Insignia Exclusiv (160) 2.0 CDTI
I asked about the 160 and was told it was the BHP of the engine.
Upon receiving the car and checking the books and such, the engine is a 130 bhp engine, not the 160 i was told or described as on the website.
The car was sold to me by a dealership close to me. I mentioned this to them and they have said they will not do anything to rectify this.
What do i do from here?

Apart from taking the car back I cant see anything else they can do to rectify the situation.
Is there a price difference between the two.
What difference is there in the driving of it.
Yes, I know it was naughty of them but do you still like the car.
Other than that, go to trading standards and ask their advice.
Do you still have the advertisement saying it was (160)

If it is on finance they (the finance company who are normally the best lever in this type of thing) will have financed the car on the reg/vin and won't really be of any help to you as nothing has been mis-described to them. You can certainly complain in an assertive, friendly manner and see what the seller says, I think though they will offer a set of mats and a bunch of flowers.0

It was not mis-sold. It was Misdescribed, which effectively means any contract is null and void; so you have two choices- Sue them for either-
The difference in value of the car.
OR
Rescind the contract i.e return the car.
You won't actually need to sue once you point this out to them, they will rectify this once you have kicked up enough stink and their lawyers have told them they are missing both legs to stand on.
You need to get some proof though!0 -

Agree 100%.
The car is not as described and therefore now you have found out, you are entitled to return the car if you want to.
It happened to me many years ago. I was sold a car described as 1999 reg but when I got the V5 I found it was registered in 1998. Miss Described is what i meant to say, but thanks for correcting me. This is the point i have tried to make with them.
Anyway, regarding proof, i have a finance invoice which states the car is a Vaxuhall Insignia Exclusiv (160) 5dr 2.0 CDTI
Their old vehicle advert page (cached from google, ive also got a copy) is located on their website
Regarding proof as to what engine is actually in the car, the manual i have states the engine is an A20DTC engine, if you go to page 184 of this manual (not allowed to post links, google a20dtc and therell be a PDF result) it states that the engine is 81BHP. After some research it turns up that the engine in my car is the 110 version of the car, not the 160.
Ive received a call from the head office of evans halshaw and i plan on relaying all of this information and looking for some kind of renumeration to sort this.0 -

The car manual (handbook?) will list the different engine designations and their respective specifcations, but have you actually cross-referenced this with the actual engine number fitted to your car???"You were only supposed to blow the bl**dy doors off!!"0

On page 184 of the insignia manual, under the column of A20DTC it states 81 BHP/KW or something.
There are 3 different engines from what i understand, 110, 130 and 160 these are A20DTC, A20DTJ, A20DTH. Mine is the first one, its stated as the engine installed in the front of my manual at home.0 -

Open the bonnet of the car, and check exactly what engine is actually fitted to the car. Ok ive done a bit more research, going by the A20DTC in the log book, these are the details of the engine which is supposed to be in the car at the moment:
81 kW (110 PS; 109 hp) @4,000 rpm
The car was sold as a 160 engine, which has the following details:
118 kW (160 PS; 158 hp) @4,000 rpm.
I plan on checking locations of engine markings and such when i get home tonight.
Does anyone know a site where i can get values of different cars?What does it say on the log book?0
