Stamp Duty refund

Hi,
I've just found out about this, but I can't seem to do the form online. It keeps saying I don't have access and doesn't give it as an option to enrol.
Has anyone else had problems or know what I need to do to get a paper copy of the form to send off?
I will be calling HMRC on Tuesday, but there isn't much time left so I was hoping to get on top of it asap.
Thanks in advance

Hi folks, does anyone know if the dates are exact dates to be able to claim a refund? I bought a place in a qualifying area but at the end of November 2003. Can I still claim, or is it strictly from 1st Dec 2003?PAYDBX 2016 #55 100% paid! :j Officially bad debt free...don't count my mortgage.

Just checked and my postcode is definitely in one of the wards. Tried to log on to submit claim online but no longer have my log-in details. Will have to phone up tomorrow and get the ball rolling.Sealed Pot Challenge No. 2860

So, I think I should be eligible for a refund as I come under the threshold and I am in a deprived area. However, solicitors have destroyed the documentation and the MSE details are definitely incorrect! You can't apply online as an individual, and they don't need you to fill in a new form.
You have to write to the Birmingham Office with the details you have and let them make the decision e.g. I have a receipt for the payment etc. It does seem slightly confusing that the solicitors are the ones who make the claim so it's their mistake but you claim back directly.
So I'm going to write today and see what happens.
Anyone else have any more clue about what to do?0 -
Oh, meant to say, this is what it says on the website.
Disadvantaged Areas Relief
Disadvantaged Areas Relief (DAR) reduced the amount of Stamp Duty Land Tax (SDLT) payable in areas designated by the government as 'disadvantaged'.
DAR was abolished for transactions with an effective date on or after 6 April 2013.
All claims to relief for purchases of residential property where the effective date is before 6 April 2013 must be made on or before 5 May 2014. Claims made after that date will not be accepted.
This guide explains which areas and properties DAR applies to, the current rates, and how to work out how much SDLT is payable if a property qualifies.
To make a claim for DAR you must complete an SDLT return even though there is no SDLT payable. The quickest and easiest way to do this is online.
This means, I think, that if you pay now you'd need to submit an SDLT online and say it's not payable, but if you're claiming about a purchase made before 6 April 2013 you have until 5 May 2014 to claim it back.
Any thoughts?0 -
Have looked at website and my previous property was in one of the areas listed as disadvantaged. Phoned HMRC this morning who told me to write a letter and include copies of any documentation I have relating to the purchase of the property. I was told I can still claim even though I have since sold the property. Address to write to is:
FAO Stamp Duty Land Tax
Birmingham Stamp Office
9th Floor
City Centre House
30 Union Street
Birmingham
B2 4AR
Hope that helps.0 -

you are correct however in noting that the deadline for claiming a refund for historic purchases (ie those between 1/12/03 and 5/4/13 inclusive) must be made before 5 May 140 -

in tax a date means a date so no you cannot claim as you were before the relief was available just the same as, for example, you cannot claim the 14/15 income tax personal allowance on 5 April but you can from 6 April0 -

I thought as much but thought it worth double checking. We missed out by a few days then. Shame.

Just picked up this thread. My property bought in 2007 is in a qualifying area and under the 150k threshold, but I can't remember if I paid and Stamp Duty! The solicitors we used have now went bust and HMRC can only check within the last 12 months. Not sure I have any receipts hidden away at home but need to check. Is there any other way of checking if I made the Stamp Duty Payment? HMRC suggested writing to the Birmingham office, but by the time I get a response surely it will be past the 5 May date and I would be too late to claim.LBM Jan 14 - Debt £30,500.48
