ESA (cb) one year rule?

Income based is either WRAG or Support grouping - and so far as I know you will be given a set time period of say 3 years and be reviewed nearer that time or when PIP comes into force and they want to migrate people over to the new benefit. Or in other words there are 3 types not 2. This was explained to me by a very helpful lady over the phone when I rang them up about their rules and the website being unclear. Everyone intitially goes down contributions route for approx first 13 weeks, during which time you most likely get sent for interview and a medical. Then if you are going for income related, you either pass with a high score of 15 points and get onto Support or if less than 15 but more than a certain amount ( you get told that you will be in WRAG) - no I have no idea what that limit is. But contributions is now £71/week and the others are in the £90+ range. Sorry do not know new levels. In my case I have an illness where it is best for me to do a year of contributions rate so that some medications that I now have to take have a chance to kick in. The hope is to try and get illness into remission.
As above... the advice you were given is misleading or incorrect in so many ways.... disregard it all! Unfortunately many agents at the DWP seem to have much less grasp of ESA than the claimants contacting them."Do not attribute to conspiracy what can adequately be explained by incompetence" - rogerblack0 -
My thanks to Anubis, that is one of the most clear and concise explanations I have seen!0

There seems to be a lot of posts regarding this new rule (cb) esa. A lot of people are not aware of it / have not been made aware of it and are asking for help on forums to get help and info.
I wrote recently as I moved abroad before I was aware of the changes, ensured it was all ok with dwp etc. But the new legislation ending the entitlement to cb based ib / esa to end after a year was only passed through parliament after very little consultation, and then was made retrospective ( maybe a year).
I made a big move abroad depending on that income, and now although I understand I'll have to go through a reassessment phase, as I have in the passed, I'm a bit worried as to how things will pan out for me.
My concern is that living abroad I have no support, I'm on my own. & should I need representation (or even someone to accompany me to a medical) I don't know who to turn to. Surely I can't ask the charities ie, CAB etc.
Could I approach a consule or other organisation to help me should I need it.
I know its not covered most forums I've tried, or the WORLD WIDE WEB for that matter!! But there must be others out there abroad that need similar help to me.
It would me such a massive change to my life if I was to find myself loosing that income, which I rely upon. I have some savings that I'm trying to make last to cover rents etc.
Hope someone could point me in some direction.0 -

Thanks,
I know IB is transferable, hence why I've set up abroad. ESA cb based is also unaffected if in the support group if my situation. It's the changes that concern me. Although I fulfill, I think the new criteria for support groupt, I understand people in the UK are having to appeal a decision for Work Group.
A lot of people, most that I can see, have a partner working and that is of concern to them as they won't qualify.
I did say I'd squared it with the DWP before leaving the country, though to be fair, as I said, these changes were quite rapidly implemented. Had I known even a year before, I might have moved to Hull:D
I've started a new thread on this so as not to rob OP's thread.0 -

Am sorry to tell you this, but I am not being assessed in same way as most people going in to ESA system. I do work 12 hours already and was getting SSP for 28 weeks before that. Whether my rate goes up or not it will not be that of the income related one at all, but will be contribution NI one. I have a limited level of work I can do - due to my illness and just how weak doing it makes me. But I am trying my best to continue. They did say it may go up by £20+ once 13 weeks are up (end of May). Will wait and see. So around 6 more weeks? I therefore get ESA and my pay until Feb next year. This I was told should definitely happen. Having spoken to 3 different people now, that has been advised each time. So there are 3 different types. 2 are income related and one is contribution related. The web site is not as clear as it ought to be and does not make this very clear, so people get more and more muddled. I know I did, hence why I rang them up. And yes I do know that ESA is not time limited, but they can and do give you a reassessment date in their letter. Especially since PIP is on way in.0 -
PIP has nothing to do with ESA0

There are two types - income related and contribution related.
Then there are two different groups in each - support group and WRAG.
In WRAG group on contribution related you get 12 months, and on income related there is no timescale.
If, after 12 months on contribution related in WRAG, you have no income, you will be transferred to income related.“How people treat you becomes their karma; how you react becomes yours.”0 -
ESA will be paid when there is no SSP.I must not fear. Fear is the mind-killer.
Fear is the little-death that brings total obliteration.
I will face my fear. I will permit it to pass over and through me. When it has gone past I will turn the inner eye to see its path.
When the fear has gone there will be nothing. Only I will remain.0
