Downgrading 3 contract

I took out a 24 month contract with 3 for an iPhone in August 2010. I pay £33 a month for this after an initial £98 charge for the iPhone.

I contacted 3 to see if I could downgrade the cost of the contract for the remaining months (due to end August 2012). I was told when taking out the contract that I would be able to do this after having the contract for 12 months.

When u contacted 3, they told me that their policy changed in December 2011 and that I was no longer able to do this. Do i have a leg to stand on if I make a complaint?

I received no prior warning of the policy changing. If I had contacted 3 in November 2011 I would have been able to change the contract without any questions being asked.

My issue is that I took out the contract under the old policy and received no warning that they were going to change the policy.

Does anybody have any advice?

    It wasn't really a policy to start with. More of a gesture of good will. So no not really. You don't have a leg to stand on.

    You relations with '3' are regulated by the T&C that you accepted, not by some policy. If the original T&C say that you can upgrade, then you do have a case. Don't know about '3', but my O2 T&C do say clearly when I can downgrade and to what tariff.

    It was always just a gesture of goodwill with Three.

    You can downgrade your contract 110 days before the end of it. I did it today. I am on a £30 a month package due to end on August 4th. They downgraded me to Sim 600 12 month contract for £15 a month.

    It was always just a gesture of goodwill with Three.

    'Gesture of goodwill' when will these business practices be made illegal, it's just another way to squirm out of something a rep has promised the customer.

    I highly doubt the reps make it clear that this is a 'gesture' rather than part of the contract.
