O2 Long Weekends

Hello friends,
I joined moneysaving expert today, and I have a small problem. I upgraded my previous O2 contract in January 07, the lady told me that the long weekend minutes will get re-freshed each weekend, so even if i have used 1999 mins, i will still get 2000 mins next weekend.
that isn't the case as i just found out looking at my bill, I told them and said that u should have the record of our conversation, and they said they dont record all conversation.
My contract says i have to pay £35 per month, however as things stand i might have to pay £168 this month.
any way out of this?

hmm... Difficult one unless the conversation has been recorded.
My advice to you is to contact customer services first and ask them to investigate, if after this point your still not satisfied with their response you can get your complaint independantly reviewed by one of Peter Erskine (MD) team.
I have to say though, i think its going to be a difficult one to prove if no record of the conversation exists and O2 will refer you to the terms and conditions of the offer.0 -
the upgrade was made over the phone, and no terms and conditions signed the second time around. and no specific things mentioned which i could do or couldn't do.
i talked to the Customer service and they said that they dont record all conversations..so I am planning to write to their complaints department. I will not pay this amount.
also, according to Contract law, is the burden of proof on me or them?0 -

As far as I am aware, this is correct, certainly if you are paying £35/month or more. You get the free weekend allowance every week. You don't get 08 numbers inclusive within this free weekend call allowance though.

i thought that 02 long weekends is 2000 mins per month not per weekend, well thats what they told me when i got my contract0

I know now that it is for the whole month and certain numbers are excluded.
but when the lady was selling the contract to me she specifically said that you get 2000 mins every weekend, and she even said that you can call anywhere...(should have mentioned certain numbers are excluded)
i have her name, the time she sld me the contract + day...and i have written to O2 about it and asked them to go through the recorded conversation which took place, if you have it.
Can any expert tell me if my position is strong, and if i have a case?0 -
to be honest i don't think you'll get much out of it.
They may offer a small reduction to your bill but as you have no concrete evidence of what she said and it is just your word against theirs they probably wont do much,

Right here is the news. I wrote them a letter explaining the situation. after 2 weeks the replied back with the usual nonsense, that u have to pay because you agreed to the contract.
I held my ground and refused to pay, the barred my mobile phone for 1 weeks..i still didn't pay and rang their customer services and asked them what they planned to do about the situation. 15 minutes on the line the Manager refunded the full amount £161. and the contract will remain the one which we initially agreed upon.0
